IN-CONTEXT TRANSLATIONS

It first states that "Where the Commission implements the budget by shared management, implementation tasks shall be delegated to Member States in accordance with the provisions of Titles I and II of part two". and then that "In cases of shared or decentralised management, in order to ensure that the funds are used in accordance with the applicable rules, the Commission shall apply clearance-of-accounts procedures or financial correction mechanisms which enable it to assume final responsibility for the implementation of the budget in accordance with Article 274 of the EC Treaty and Article 179 of the Euratom Treaty".
Il s'agit premièrement du fait que «lorsque la Commission exécute le budget de façon partagée, des tâches d'exécution du budget sont déléguées à des Etats membres conformément aux dispositions des titres I et II de la deuxième partie »; et deuxièment que « dans les cas de gestion partagée[...], afin de s'assurer de l'utilisation des fonds conformément à la réglementation applicable, la Commission met en oeuvre des procédures d'apurement des comptes ou des mécanismes de corrections financières lui permettant d'assumer sa responsabilité finale dans l'exécution du budget conformément à l'article 274 du traité CE et à l'article 179 du traité Euratom».

This communication fulfils the commitment given by the Commission in the "Synthesis Of Annual Activity Reports 2002 of DGs and Services" [1] to carry out a legal analysis of its responsibilities and those of the Member States for the shared management of the budget of the European Communities and to clarify the procedures through which, in cooperation with the Member States, it can discharge its general responsibility for the implementation of the budget [2].
Cette communication répond à l'engagement pris par la Commission dans la «Synthèse des rapports annuels d'activité 2002 des Directions générales et services» [1] d'effectuer une analyse juridique des responsabilités de la Commission et des Etats membres pour la gestion partagée du budget des Communautés européennes, et de clarifier les procédures à travers lesquelles la Commission, en coopération avec les Etats membres, peut s'acquitter de sa responsabilité générale d'exécution du budget [2].
