L'acte du 14 septembre 1999 qui porte sur l'interprétation de l'article relatif à la constitution des groupes politiques et dont l'adoption par la plénière entraînait une déclaration de non-conformité du groupe TDI aux prescriptions du règlement, ne peut être ramené, aux yeux du Tribunal, à une telle catégorie d'actes et doit donc pouvoir faire l'objet d'un contrôle de légalité par le juge communautaire.
