Definition: Reliance on some non-living object as a stimulus for sexual arousal and sexual gratification. Many fetishes are extensions of the human body, such as articles of clothing or footwear. Other common examples are characterized by some particular texture such as rubber, plastic or leather. Fetish objects vary in their importance to the individual. In some cases they simply serve to enhance sexual excitement achieved in ordinary ways (e.g. having the partner wear a particular garment).

Following the assessment of all Hungarian replies, the Commission upholds its view that the modified law violates the freedom to provide services (Article 56 TFEU); the freedom of establishment (Article 49 TFEU); Directive 2006/123/EC on services in the internal market (Article 16); the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union (Articles 13, 14, 16 respectively); as well as the Union's legal obligations under international trade law (the General Agreement on Trade in Services – GATS – in the framework of the World Trade Organisation, WTO).
Après avoir évalué toutes les réponses de la Hongrie, la Commission reste d'avis que la loi modifiée viole la libre prestation des services (article 56 du TFUE), la liberté d'établissement (article 49 du TFUE), la directive 2006/123/CE relative aux services dans le marché intérieur (article 16), le droit de la liberté académique, le droit à l'éducation et la liberté d'entreprise tels que consacrés par la charte des droits fondamentaux de l'Union européenne (articles 13, 14 et 16 respectivement), ainsi que les obligations juridiques de l'Union au titre du droit du commerce international, à savoir l'accord général sur le commerce des services (AGCS) dans le cadre de l'Organisation mondiale du commerce (OMC).

Having assessed the reply by the Hungarian authorities, the Commission maintains its legal assessment that the law as amended is not compatible with the fundamental internal market freedoms, notably the freedom to provide services (Article 56 TFEU and Article 16 of Directive 2006/123/EC on services in the internal market) and the freedom of establishment (Article 49 TFEU and Articles 9, 10, 13, 14 of Directive 2006/123/EC), but also not compatible with the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union (Articles 13, 14, 16 respectively), as well as not compatible with the Union's legal obligations under international trade law (the General Agreement on Trade in Services – GATS – in the framework of the World Trade Organisation, WTO).
Après avoir examiné la réponse des autorités hongroises, la Commission maintient son appréciation juridique selon laquelle la loi modifiée n'est pas compatible avec les libertés fondamentales du marché intérieur, notamment la libre prestation de services (article 56 du TFUE et article 16 de la directive 2006/123/CE relative aux services dans le marché intérieur) et la liberté d'établissement (article 49 du TFUE et articles 9, 10, 13 et 14 de la directive 2006/123/CE), ni avec la liberté académique, le droit à l'éducation et la liberté d'entreprise prévus par la charte des droits fondamentaux de l'Union européenne (respectivement articles 13, 14 et 16), ni avec les obligations juridiques de l'Union au titre du droit commercial international (à savoir l'accord général sur le commerce des services dans le cadre de l'Organisation mondiale du commerce).

Ø The Commission proposal also introduces procedures for authorisation and granting of licenses which are subject to compliance with essential universal service obligations (Article 9), transparent and non-discriminatory access to the downstream sector (distribution) of postal infrastructure (Article 11a), and rules on accounting separation and cost calculation distinguishing between providers of market services and providers of universal service (Article 14).
Ø La proposition de la Commission établit également des procédures d'autorisation et d'octroi de licences, liées au respect d'exigences essentielles et de service universel (article 9), d'accès transparent et non discriminatoire au segment aval (distribution) de l'infrastructure postale (article 11 bis); des règles de séparation comptable et de calcul des coûts, entre prestataires de services marchands et prestataires de service universel (article 14).

With regard to Article 49 of the EC Treaty, concerning the free movement of services, Articles 14(1)(a), 14(1)(b) and 17 of Council Regulation (EEC) No 1408/71 on insurance and social security schemes and the provisions of Directive 96/71/EC on the posting of workers, in particular Articles 1(3) and 3(1), is the Commission aware that the German health insurance body the DVKA is calling for employees from other Member States, posted to Germany for the provision of services, to be required to pay social security contributions to the DVKA?

(1b) Although free movement of persons (article 2), goods (article 23) and services (article 49) is embedded in the Treaty, the lack of information on the many differences in national regulations in the field of fiscal and labour laws restrains the free circulation of audiovisual goods and services.
