In the event of actual or anticipated inheritance, the separate sugar payment referred to in Article 126, the separate fruit and vegetables payment referred to in Article 127 and the separate soft fruit payment referred to in Article 129 shall be granted to the farmer who inherited the holding, on condition that this farmer is eligible under the single area payment scheme.

By way of derogation from paragraph 2, each new Member State concerned may decide, by 31 March of the year in respect of which the separate sugar payment is granted and on the basis of objective criteria, to apply for the separate sugar payment a ceiling lower than that listed in Annex XV. Where the sum of the amounts determined in accordance with paragraph 1 exceeds the ceiling decided by the new Member State concerned, the annual amount to be granted to the farmers shall be reduced proportionally.
3. Par dérogation au paragraphe 2, chaque nouvel État membre concerné peut décider, au plus tard le 31 mars de l'année pour laquelle le paiement séparé pour le sucre est accordé et sur la base de critères objectifs, d'appliquer, pour ce paiement, un plafond inférieur à celui visé à l'annexe XV. Si la somme des montants fixés conformément au paragraphe 1 dépasse le plafond fixé par le nouvel État membre concerné, le montant annuel à accorder aux agriculteurs est réduit proportionnellement.

(30) To ensure a sound administration of the choices made by Member States concerning the coupled payments, the Commission should fix the ceilings corresponding to the single payment scheme, to the coupled measures within the specific support, the separate sugar payment, the separate fruit and vegetables payment, the separate soft fruit payment and the funds notified by the Member States in accordance with Article 69(6)(a).
(30) Afin d’assurer une bonne gestion des choix effectués par les États membres en matière de paiements couplés, il convient que la Commission arrête les plafonds correspondant au régime de paiement unique, aux mesures couplées dans le cadre du soutien spécifique, au paiement séparé pour le sucre, au paiement séparé pour les fruits et légumes, au paiement séparé pour les fruits rouges et aux fonds notifiés par les États membres conformément à l’article 69, paragraphe 6, point a).

Farmers applying for the sugar payment provided for in Chapter 10e of Title IV of Regulation (EC) No 1782/2003, farmers applying for the aid for sugar beet and cane producers provided for in Chapter 10f of Title IV of that Regulation and farmers applying for the separate sugar payment provided for in Article 143ba of that Regulation shall submit an aid application containing all information necessary to establish eligibility for the aid, and in particular:

Les agriculteurs qui présentent une demande de paiement relatif au sucre prévu au titre IV, chapitre 10 sexies, du règlement (CE) no 1782/2003, les agriculteurs qui présentent une demande d’aide en faveur des producteurs de betteraves et de cannes à sucre prévue au titre IV, chapitre 10 septies, dudit règlement et les agriculteurs qui présentent une demande de paiement séparé pour le sucre prévu à l’article 143 ter bis dudit règlement soumettent un dossier contenant toutes les données nécessaires pour établir l'éligibilité à l'aide, et notamment:

The aid application for the sugar payment, the aid for sugar beet and cane producers or the separate sugar payment respectively shall be submitted by a date to be fixed by the Member States which shall not be later than 15 May and, in the case of Estonia, Latvia, Lithuania, Finland and Sweden, not later than 15 June.
2. La demande d'aide concernant respectivement le paiement relatif au sucre, l’aide en faveur des producteurs de betteraves et de cannes à sucre ou le paiement séparé relatif au sucre est introduite dans un délai fixé par les États membres et qui ne peut aller au-delà du 15 mai ou, dans le cas de l’Estonie, de la Lettonie, de la Lituanie, de la Finlande et de la Suède, au-delà du 15 juin.
