Those conditions do not infringe Article 11(1) of the Conditions of Employment of Other Servants or the second sentence of Article 25 of the Staff Regulations since, although those provisions imply, in principle, that an individual decision adversely affecting a staff member must set out all the reasons for which it was adopted, in order to allow the person concerned to ascertain whether it is well founded and to make it possible for the Union judicature to review its lawfulness, where appropriate, the fact remains that awareness, by the staff member concerned, of the context in which a decision was adopted may constitute a statement of reasons for that decision.

Article 4(1)(c) contains a discretionary provision which enables the judgment and the certificate to be forwarded, for example, to the Member State of nationality of the sentenced person, in cases other than those provided for in paragraphs 1(a) and (b) or to the Member State in which the sentenced person lives and has been legally residing continuously for at least five years and will retain a permanent right of residence there.

At all events, the proposal must be consistent with the provisions of Article 10, paragraph 2, of the Council of Europe Convention on the Transfer of Sentenced Persons of 21 March 1983 which applies the principle of 'continued enforcement' and not that of "adapting the sanction", which is contrary to the principle of mutual recognition.

(4) Regulations consistent with the provisions of the first sentence shall not be considered to be contrary to the provisions of the second sentence in any case in which all of the products subject to the regulations are produced domestically in substantial quantities.
