The transfer of enforcement of a sentence needs the agreement of the sentencing State and the administering State and may take place only if it satisfies all the conditions set out in Article 5 of the Convention, namely: (a) the judgment is final and enforceable; (b) the acts or omissions on account of which the sentence has been imposed constitute one of the offences referred to in Article 1(1)(a) according to the law of the administering State or would constitute such an offence if committed in its territory ("dual criminality"); (c) under the laws of the sentencing State or the administering State, the enforcement is not barred by time limitations; (d) final judgment against the sentenced person in respect of the same acts has not been delivered in the administering State; and (e) when a final judgment against the sentenced person in respect of the same acts has been delivered in a third State, the transfer of enforcement would not run counter to the principle of prohibiting double jeopardy.
La transmission de l'exécution d'une condamnation est subordonnée à l'accord de l'État de condamnation et de l'État d'exécution et ne peut intervenir par ailleurs qu'aux conditions cumulatives énumérées à l'art.5 de la Convention : a) le jugement est définitif et exécutoire ; b) les actes ou omissions qui ont donné lieu à la condamnation constituent l'une des infractions mentionnées à l'article 1 paragraphe 1 point a), au regard du droit de l'État d'exécution ou en constitueraient une s'ils intervenaient sur son territoire -« double incrimination »; c) la sanction n'est prescrite ni selon la loi de l'État de condamnation ni selon celle de l'État d'exécution ; d) dans l'Etat d'exécution, il n'existe pas de jugement définitif à l'égard de la personne condamnée pour les mêmes faits ; e) lorsqu'il existe un jugement définitif pour les mêmes faits à l'égard de la personne condamnée dans un État tiers, la transmission de l'exécution ne serait pas contraire au principe "ne bis in idem".

A Member State would not be fulfilling its obligations if were to extradite a person to a third State where that person might be sentenced to the death penalty, unless the Member State had first sought sufficient assurances from the third State concerned that the death penalty would not be imposed on the person in question or that, if imposed, it would not be enforced.
