It is necessary to establish appropriate measures to ensure both the necessary protection of sensitive safety data and to provide the public with adequate information pertaining to the level of civil aviation safety and environmental protection relating thereto, taking into account Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents and relevant national legislation.

As regards the number of sensitive documents not recorded in the register as foreseen in Regulation 1049/2001, Parliament states that it neither drew up nor received any sensitive document. Council writes that 250 sensitive documents were produced of which 77 are referred to in the register. The Commission only mentions that among the three categories of documents presently covered by the register (COM, C, SEC) there are no sensitive documents.

We also realise this. Having a small group of members who have access to these highly sensitive documents is, however, one way of ensuring a certain degree of, admittedly limited, parliamentary control in this area, which thus puts pressure on the Council.

The Council approved a draft interinstitutional agreement concerning access by the European Parliament to sensitive information held by the Council in the field of security and defence policy, and authorised the Presidency to sign this agreement on behalf of the Council. In view of the specific nature and especially sensitive content of certain highly classified information in the field of security and defence policy, special arrangements are introduced for the handling of documents.

(3) In conformity with Article 9(7) of Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents(1), the Council is to inform the European Parliament regarding sensitive documents as defined in Article 9(1) of that Regulation in accordance with arrangements agreed between the institutions.
(3) Conformément à l'article 9, paragraphe 7, du règlement (CE) n° 1049/2001 du Parlement européen et du Conseil du 30 mai 2001 relatif à l'accès du public aux documents du Parlement européen, du Conseil et de la Commission(1), le Conseil est tenu d'informer le Parlement européen au sujet des documents sensibles tels qu'ils sont définis à l'article 9, paragraphe 1, dudit règlement, selon les dispositions convenues entre les institutions.
