I would begin by thanking my colleague Adriana Poli Bortone, now a senator of the Italian Republic, from whom I inherited the draft report and an already detailed, meticulous study of the topic; next my staff, who have supported me enthusiastically and conscientiously in furthering my exploration and analysis of the phenomenon; and finally the shadow rapporteurs, whose commitment undoubtedly contributed to the adoption of the text in the Committee on the Environment, with a virtually unanimous cross-party consensus.
Je voudrais commencer par remercier ma collègue Adriana Poli Bortone, qui siège désormais au sénat italien, et qui m'a transmis le projet de rapport ainsi qu'une étude déjà bien documentée et détaillée sur ce sujet. Senator Kinsella pointed out in debate on the point of order raised by Senator Lynch-Staunton that we have a standing committee, namely, the Standing Senate Committee on Legal and Constitutional Affairs, that by our rules would be the standing committee to which a bill such as Bill C-20 would be referred. His Honour points out in his ruling that the bill could be sent to any committee that the Senate determined would be appropriate for receipt of the bill.

Senator Kinsella: Would the Honourable Senator Cools give us her view on whether it would constitute a breach of privilege of a senator and, therefore, a breach of privilege of this house if the government picked on a member of this house by deciding not to send a particular legislative initiative to a particular committee because that senator were a member of that committee?

I was struck too at the Senate Judiciary Committee hearing of Attorney General John Ashcroft by the way in which the proposal for military tribunals – the executive order from the President – would provide for hearings in secret, for a prosecution being able to withhold evidence from the defence, for defendants not necessarily having the right to an independent lawyer or to a private conversation with their lawyer, and by how a sentence – including a death sentence – can be passed by a majority of two-thirds of the jurors.
