d) The Commission considers in particular that the combined effect of the provisions on the appointment of an acting President of the Tribunal, the selection procedure for the candidates to the post of President and the refusal to swear in the judges elected by the 7 Sejm while providing for the taking up of office of the three judges nominated by the 8th term of the Sejm without a valid legal basis, seriously threaten the legitimacy of the Constitutional Tribunal and consequently the effectiveness of the constitutional review.
d) la Commission considère en particulier que l'effet conjugué des dispositions concernant la nomination d'un président du Tribunal faisant fonction, la procédure de sélection des candidats au poste de président et le refus de recueillir le serment des juges élus par la 7 législature de la Diète tout en permettant l'entrée en fonction des trois juges nommés par la 8 législature de la Diète sans base juridique valable menace la légitimité du Tribunal constitutionnel et, par conséquent, le caractère effectif du contrôle de la constitutionnalité.
