Draws attention to the fact that even before the 11 September 2001 attacks the Bureau and the Secretary-General had turned their attention to security policy; refers to the notes of 14 September 2000 , 9 May 2001 , 18 September 2001 and 20 February 2002 ; endorses the measures in force concerning stricter checks on access and better checks on visitors; urges a stepping-up of the cooperation with national security services that is essential for the security of the buildings in Brussels, Luxembourg and Strasbourg; regrets that the police surveillance of the buildings in Brussels is inadequate; calls on the Belgian Government to provide the same security for the European Parliament's buildings as for the federal and regional parliaments, inter alia by enlisting the services of the Military Police (MP);

124. As regards the applicant’s complaint that his views were heard after the Secretary-General had consulted the Quaestors, with the result that the latter were not able to take account of his comments, it must be recalled that, as consultation with the Quaestors does not bind the Secretary-General as regards his decision on the inference to be drawn from the absence of supporting documents, the fact that the applicant’s views were heard after the said consultation was not such as to infringe the rights of the defence.
124 En ce qui concerne le reproche du requérant selon lequel il a été entendu après la consultation par le secrétaire général des questeurs, de sorte que ces derniers n’ont pas pu tenir compte de ses remarques, il y a lieu de rappeler que, la consultation des questeurs ne liant pas le secrétaire général quant à sa décision sur les conséquences à tirer de l’absence de pièces justificatives, le fait que le requérant ait été entendu après ladite consultation n’a pas été de nature à violer les droits de la défense.

Nevertheless, the Secretary-General had invoked Article 4(3) of Regulation No 1049/2001, and in particular the fact that the institution had not yet reached a final decision, in order to justify the Parliament’s refusal to accede to the applicant’s request.

With regard to the applicant’s letter of 21 April 2003 (see paragraph 67 above), the Parliament observes that the letter could not have triggered the procedure under Article 27(2) of the Rules Governing the Payment of Expenses and Allowances, as at that time the Secretary-General had not reached a final decision.

With regard to the breach of Article 27(2) of the Rules Governing the Payment of Expenses and Allowances, the applicant observes that, as a result of his letter of 21 April 2003 (see paragraph 43 above), in which he had pointed out that the Rules Governing the Payment of Expenses and Allowances had been incorrectly applied in his regard, and given that no agreement had been reached between the Secretary-General and himself, the matter should have been referred to the Quaestors in accordance with that article for them to take a decision after consulting the Secretary-General and, where appropriate, the President or the Bureau.

By letter of 12 April 2002 the Secretary-General of the Parliament (‘the Secretary-General’) reminded the applicant of the various allowances that had been paid to him since the beginning of his term of office and asked him to provide, by the end of April 2002, facts and figures on the use of the credits paid as secretarial allowances between 1999 and 31 January 2001 and details on the use of credits paid as general expenditure allowances.
