Nor, since the Home Secretary had, by order of 23 June 2008 which entered into force the following day, struck the PMOI’s name from the list of organisations proscribed under the Terrorism Act 2000, could the Home Secretary’s order of 28 March 2001, a decision of a competent authority that formed the basis for Decision 2007/868, any longer serve as grounds for the inclusion of the PMOI in the list referred to in Article 2(3) of Regulation No 2580/2001, on pain of contravening Article 1(4) of Common Position 2001/931.
