International conventions and agreements, together with unilateral acts (i.e. regulationsdirectivesdecisions, opinions and recommendations), constitute the secondary legislation of the EU.

(3) Certain articles of the Convention affect Community secondary legislation on jurisdiction and the recognition and enforcement of judgments, in particular Council Regulation (EC) No 1347/2000 of 29 May 2000 on jurisdiction and the recognition and enforcement of judgments in matrimonial matters and in matters of parental responsibility for children of both spouses(1).

51. Having regard to all the foregoing considerations, and as is also clear from the express terms of the eighth recital in the preamble to the Convention, according to which the commercial and environmental policies of the parties to the Convention should be mutually supportive with a view to achieving sustainable development, it must therefore be concluded that the Convention includes, both as regards the aims pursued and its contents, two indissociably linked components, neither of which can be regarded as secondary or indirect as compared with the other, one falling within the scope of the common commercial policy and the other within that of protection of human health and the environment.
51. Au regard de l'ensemble des considérations qui précèdent, et ainsi que cela ressort d'ailleurs explicitement du huitième considérant du préambule de la convention, aux termes duquel les politiques commerciales et environnementales des parties à la convention devraient être complémentaires afin d'assurer l'avènement d'un développement durable, il convient donc de conclure que celle-ci comporte, tant sur le plan des finalités poursuivies que sur celui de son contenu, deux composantes liées de façon indissociable, sans que l'une puisse être considérée comme seconde ou indirecte par rapport à l'autre, relevant, l'une, de la politique commerciale commune et, l'autre, de la protection de la santé humaine et de l'environnement.

T. whereas there are about 100 million children in the European Union and about 80 million European persons with disabilities; whereas persons with disabilities, especially children, are still suffering from a lack of assistance and support as regards their inclusion in schools, and are experiencing difficulties in accessing buildings or services and trouble in being heard and participating in decisions affecting their lives; whereas the EU, as a party to the UN Convention on the Rights of Persons with Disabilities, has the obligation to promote, protect and respect the rights of persons with disabilities as enshrined in the Convention, to adopt a strategy to implement the Convention and to ensure that policies and existing and future primary and secondary law comply with the provisions of the Convention;

Calls for the continuation of the process of signature, conclusion and ratification of the Convention on the Rights of Persons with Disabilities, including its Optional Protocol, and recalls that, following ratification of the Convention by the Community, any proposed Community non-discrimination legislation must comply with the requirements of the Convention in full; reminds the Council about its call on the Commission, made at the informal ministerial conference on disability in June 2007, to launch a European strategy for the effective implementation of the Convention; calls upon the Commission, within that framework, to evaluate the need to amend secondary Community legislation or adapt relevant policies;

For the purpose of Article 8(5)(a) of the Convention as amended by the Protocol of Amendment, the European Community hereby informs the depository of the Convention that the European Community is competent for all matters governed by the body of the Convention and its General Annex, except for those matters not falling within its exclusive explicit or implicit competence as laid down in the Treaty establishing the European Community as amended and within secondary Community legislation.
Aux fins de l'article 8, paragraphe 5, point a), de la convention telle que modifiée par le protocole d'amendement, la Communauté européenne informe le dépositaire de la convention que la Communauté européenne est compétente pour toutes les matières couvertes par le dispositif de la convention et son annexe générale, à l'exclusion de celles qui ne relèvent pas de sa compétence exclusive, explicite ou implicite, telle que prévue dans le traité instituant la Communauté européenne tel que modifié, et dans le droit communautaire dérivé.
