By the second ground of appeal, the appellants claim that, in breach of the rights of defence and the duty to state reasons, the General Court rejected their argument that the Commission decision should have been declared void because the proportions of liability in the internal relationship of the joint and several debtors were not determined in conformity with the judgment since delivered by the General Court in Joined Cases T-122/07 to T-124/07 Siemens Österreich [2011] ECR II-793.

The second ground of appeal contests the combination in law of factually and legally unrelated conduct into an allegedly single, complex and continuous infringement (‘SCCI’), which in the applicant’s view should not have legally taken place because of the lack of complementarity between the conduct that was assessed together. In the way it was used in this case, the concept of the SCCI infringes the principle of a right to a fair trial.
Dans le cadre du deuxième moyen, la requérante reproche au Tribunal d’avoir qualifié juridiquement plusieurs pratiques d’infraction unique, complexe et continue (single complex and continuous infringement), alors que ces pratiques étaient indépendantes tant en droit qu’en fait et qu’une telle qualification n’était pas justifiée en raison du défaut de complémentarité des pratiques examinées conjointement.

In the second part, the appellant principally alleges a breach by the General Court of the requirement to state reasons, in that the judgment under appeal could not consider that a sufficient statement of reasons was given for the decision of the First Board of Appeal on the application of Article 7(1)(b), a decision which does not specify any of the documents upon which it seeks to rely, and could not consider that it was unnecessary to refer to items of evidence because the First Board of Appeal allegedly relied upon “deductions made from practical experience”.
