In September 2012, several citizens filed a complaint with the Commission against alleged illegal state aid granted by Portugal to EDP through two distinct measures: firstly, the extension of concessions to use public water resources at allegedly favourable conditions and secondly, allegedly excessive compensations for past investments said to burden EDP in the liberalised market environment ("stranded costs").
En septembre 2012, plusieurs citoyens ont déposé une plainte auprès de la Commission pour une aide d’État illégale présumée accordée par le Portugal à EDP au moyen de deux mesures distinctes: premièrement, la prolongation de concessions en vue d'utiliser des ressources hydrauliques publiques à des conditions prétendument favorables et, deuxièmement, des compensations prétendument excessives pour des investissements passés qui auraient handicapé EDP sur un marché libéralisé («coûts échoués»).

S. whereas the Commission’s argument concerning the second allegation of maladministration was that the EIA Directive did not establish any provisions regarding the distribution of competences in respect of the EIA procedure to be conducted in the Member States; whereas in line with the principle of subsidiarity it is entirely for the Member States, being responsible for the organisation of their own administration, to decide which authority should be in charge of procedures under the EIA Directive, and whereas it is a general principle of administrative law in all Member States that an authority which has taken an unlawful decision which has been subject to an administrative appeal or court ruling is in charge of remedying the situation;

7. Considers, with regard to the Ombudsman's second allegation, that an honest, active and comprehensive inclusion of the local population in the application of the EIA Directive is on the whole essential and thus believes that open and transparent mediation procedures should be carried out more frequently ahead of projects with a potential major impact on the local environment and human health; in this context, acknowledges the public mediation which took place ahead of the EIA concerning the construction of a third runway at Vienna Airport in which also the cumulative impact, e.g. the noise nuisance, of the enlargements which triggered the infringement case at hand was assessed and for which a full review procedure is available;
7. considère, en ce qui concerne la deuxième allégation du Médiateur, qu'il est en général essentiel de faire participer la population locale de manière honnête, active et complète à l'application de la directive «EIE», et estime donc qu'il convient de mener plus fréquemment des procédures de médiation ouvertes et transparentes avant la mise en œuvre de projets susceptibles d'avoir des incidences notables sur l'environnement local et la santé humaine; dans ce contexte, salue la médiation publique menée avant l'EIE concernant la construction d'une troisième piste à l'aéroport de Vienne par laquelle l'effet cumulatif (notamment les nuisances sonores) des agrandissements qui ont déclenché la procédure d'infraction en question a également été évalué et contre laquelle un recours total est possible;

F. whereas the Lithuanian authorities have reiterated their commitment to reopening the criminal investigation into Lithuania’s involvement in the CIA programme if new elements emerge, but still have not done so; whereas in their observations to the ECtHR in the case of Abu Zubaydah, the Lithuanian authorities demonstrated critical shortcomings in their investigations and a failure to grasp the meaning of the new information; whereas Lithuania holds the presidency of the Council of the European Union in the second half of 2013; whereas a complaint was submitted on 13 September 2013 to the Lithuanian Prosecutor General, calling for an investigation into allegations that Mustafa al-Hawsawi, who is currently facing trial by military commission at Guantánamo Bay, had been illegally transferred to, and secretly detained and tortured in, Lithuania as part of a CIA-led programme;

I don't know that I can usefully comment specifically on allegations one and three as such without just making a general remark that would apply to all three allegations, particularly the second allegation.
