Calls on all EU institutions, bodies, offices and agencies to apply Regulation (EC) No 1049/2001 in a way coherent with the provisions of the Aarhus Convention; calls in that regard on the Commission to make public the conformity-checking studies regarding transposition of EU environmental directives and scientific studies, for example on the impact of biofuels , and calls on the European Chemicals Agency (ECHA) to fully apply Article 119 of Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) with regard to electronic public access, to only accept confidentiality claims that are clearly justified as valid under Article 119(2) of REACH, and to interpret the information that is normally deemed to undermine the protection of commercial interests pursuant to Article 118(2) of REACH strictly and without prejudice to its obligation pursuant to Regulation (EC) No 1049/2001 to balance any granting of confidentiality against a possible overriding public interest on a case-by-case basis;

This should include also third-country nationals who seek to remain on the territory of a Member State in order to exercise a paid economic activity and who are legally resident in that Member State under other schemes, such as students having just completed their studies or researchers having been admitted pursuant to Council Directive 2004/114/EC of 13 December 2004 on the conditions of admission of third-country nationals for the purposes of studies, pupil exchange, unremunerated training or voluntary service and Council Directive 2005/71/EC of 12 October 2005 on a specific procedure for admitting third-country nationals for the purposes of scientific research respectively, and who do not enjoy consolidated access to the labour market of the Member State under Community or national law.

Of course all these measures cannot simply be decreed, they entail scientific studies and reports. This is where the reform of the CFP should have begun, in order to obtain more information on resources and set an example of responsible fishing to the world, by creating specific scientific programmes for the various species, classified by geographical areas of the sea, in order to evaluate on a permanent basis the state of stocks and their biological evolution, learn about their spawning areas and seasons, which particularly require protection, promote research and training and oceanographic research projects using our own vessels and the enormous resources we have available under the EU's RD programmes, and winning the battle against public opinion, which because of either bias or the simplistic influence of the media, considers fishing and fishermen as merely predatory.

This has less to do with the standards under which a trial is conducted, given that clinical trials carried out outside the EU have to meet the ethical and scientific requirements of the EU provisions on clinical trials[24], than with the fact that studies within the EU may provide patients there with early access to innovative medicines.
