One last point I would like to add is that the suggestion which the Commission has made on the proposal for a Council decision for introducing this evaluation mechanism has significant implications for new Member States as well, as we are discussing in this case a procedure for implementing the Schengen acquis provisions in two stages.

(12) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis which fall within the area referred to in Article 1, point G of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/261/EC of 28 February 2008 on the signature, on behalf of the European Community, and on the provisional application of certain provisions of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (7).

In accordance with the second subparagraph of Article 3(2) of the 2003 Act of Accession and as a result of the partial application of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland provided for in Council Decision 2004/926/EC of 22 December 2004 on the putting into effect of parts of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland (5), and in particular the first subparagraph of Article 1 thereof, only part of the provisions of the Schengen acquis applicable to the Member States concerned in their relations with Member States applying the Schengen acquis in full should apply in the relations of the Member States concerned with the United Kingdom of Great Britain and Northern Ireland.
Conformément à l'article 3, paragraphe 2, deuxième alinéa, de l'acte d'adhésion de 2003 et du fait de l'application partielle de l'acquis de Schengen par le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord prévue dans la décision 2004/926/CE du Conseil du 22 décembre 2004 relative à la mise en œuvre de certaines parties de l'acquis de Schengen par le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord (5), et en particulier son article 1er, premier alinéa, une partie seulement des dispositions de l'acquis de Schengen applicables aux États membres concernés dans leurs relations avec les États membres qui appliquent la totalité de l'acquis de Schengen devrait s'appliquer dans les relations des États membres concernés avec le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord.

Member States have used various methods of implementing this provision, some referring to the relevant Schengen acquis provisions, some referring to a criminal offence with custodial sentence.

As regards Switzerland, except insofar as it establishes an exchange of information on the problems associated with the return of third-country nationals other than those who do not fulfil or who no longer fulfil the conditions for a short stay applicable within the territory of a Member State by virtue of the provisions of the Schengen acquis, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement signed between the European Union, the European Community and the Swiss Confederation concerning the implementation, application and development of the Schengen acquis (7), which fall within the areas referred to in Article 1, points A, B, C and E of Decision 1999/437/EC read in conjunction with Article 4(1) of Council Decision 2004/849/EC of 25 October 2004 (8) and of Council Decision 2004/860/EC of 25 October 2004 (9) on the signing of that Agreement on behalf of the European Union and the European Community, respectively, and on the provisional application of certain provisions thereof.
En ce qui concerne la Suisse, et sauf dans la mesure où elle instaure un échange d'informations sur les problèmes associés au retour des ressortissants de pays tiers autres que ceux qui ne remplissent pas ou ne remplissent plus les conditions prévues pour bénéficier d'un court séjour, applicables sur le territoire d'un État membre en vertu des dispositions de l'acquis de Schengen, la présente décision constitue un développement des dispositions de l'acquis de Schengen au sens de l'accord signé entre l'Union européenne, la Communauté européenne et la Confédération suisse sur l'association de la Confédération suisse à la mise en œuvre, à l'application et au développement de l'acquis de Schengen (7), qui relèvent des domaines visés à l'article 1er, points A), B), C) et E), de la décision 1999/437/CE lu en liaison avec l'article 4, paragraphe 1, des décisions 2004/849/CE du Conseil du 25 octobre 2004 (8) et 2004/860/CE du Conseil du 25 octobre 2004 (9) relatives à la signature, au nom de l'Union européenne de la Communauté européenne, respectivement, et à l'application provisoire de certaines dispositions dudit accord.
