The difficulty we have in evaluating the application of the Schengen acquis lies precisely in the difficulty we have in accepting that it makes provision for the exchange of sensitive information, the ‘personal files’ and repressive mechanisms which have been created with the excuse of the protection of, and free movement in, the European area.

The Council has now verified, in accordance with the applicable Schengen evaluation procedures as set out in the Decision of the Executive Committee of 16 September 1998 setting up a Standing Committee on the evaluation and implementation of Schengen (SCH/Com-ex (98) 26 def.) (2), that the necessary conditions for the application of the Schengen acquis have been met in all other areas of the Schengen acquis — Air Borders, Land Borders, Police Cooperation, the Schengen Information System, Sea Borders and Visas — in the Member States concerned.

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis (10), to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.
Le Royaume-Uni participe à la présente décision, conformément à l'article 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne et à l'article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen (10), pour autant que ses mesures développent les dispositions de l'acquis de Schengen afin de lutter contre l'organisation de l'immigration illégale auxquelles le Royaume-Uni participe, et conformément à l'article 3 du protocole sur la position du Royaume-Uni et de l'Irlande annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne, ayant notifié son souhait de participer à l'adoption et à l'application de la présente décision.

The High Contracting Parties undertake to make all efforts in order to make action among all Member States possible in the domains of the Schengen acquis, in particular whenever Ireland and the United Kingdom of Great Britain and Northern Ireland have accepted some or all of the provisions of that acquis in accordance with Article 4 of the Protocol integrating the Schengen acquis into the framework of the European Union.
Les Hautes Parties Contractantes s'engagent à tout mettre en oeuvre afin que l'action de l'ensemble des États membres soit possible dans les domaines relevant de l'acquis de Schengen, en particulier dans la mesure où l'Irlande ou le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord ont accepté tout ou partie des dispositions de cet acquis conformément à l'article 4 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne.
