(8) In order to ensure that the measures that are envisaged are not applied in a manner which would constitute a means of arbitrary or unjustifiable discrimination between countries where the same conditions prevail, or a disguised restriction on international trade, it is necessary that the adoption of such measures be preceded by an evaluation of their expected environmental, trade, economic and social effects.

4. In adopting measures in accordance to this Regulation, the Commission shall, in order to ensure that the envisaged measures are not applied in a manner which would constitute a means of arbitrary or unjustifiable discrimination between countries where the same conditions prevail, or a disguised restriction on international trade, evaluate the environmental, trade, economic and social effects of those measures in the short and long terms and the administrative burden associated to their implementation.
4. It should be noted here that the Council Framework Decision of 6 December 2001 amending Framework Decision 2000/383/JHA on increasing protection by criminal penalties and other sanctions against counterfeiting in connection with the introduction of the euro [65] requires each Member State to recognise the principle of the recognition of previous convictions under the conditions prevailing under its domestic law and, under those same conditions, shall recognise for the purpose of establishing habitual criminality final sentences handed down in another Member State for the offences referred to in the Framework Decision.

So while the arbitrary or unjustifiable discrimination test may be valid in the context of environmental policy measures, it cannot be on the basis of "where the same conditions prevail" between countries, as the environment of one country by definition differs from that of another, even where certain similarities (e.g. climate) may pertain.
Ainsi, si le test sur la discrimination arbitraire ou non justifiable peut être valable dans le cadre des mesures liées à la politique environnementale, cela ne peut être sur la base du principe suivant lequel "les mêmes conditions prévalent" dans les différents pays, vu que l'environnement est par définition un domaine qui diffère d'un pays à l'autre, même si l'on retrouve certaines similarités, notamment en ce qui concerne le climat.
