IN-CONTEXT TRANSLATIONS

WHEREAS an Association known as the Canadian Red Cross Society has been in operation for some years past, and was actively engaged during the late war in South Africa in contributing funds and tending the sick and wounded; and whereas the said association was in affiliation with the Society in England known as " The National Society for Aid to the Sick and Wounded in War" , and the work, operations and powers of the last named Society have now been transferred to and are being carried on, under the patronage of His Majesty King Edward the Seventh, by the British Red Cross Society, with which the Canadian Red Cross Society has now become affiliated; and whereas the International Conference of Geneva of 1863 recommended: " That there should exist in every country a Committee whose mission consists in co-operating in times of war with the hospital service of the armies by all means in its power" ; and whereas it is expedient that there should be a permanent organization in Canada in affiliation with the British Red Cross Society to carry out the purposes of the said treaty, and especially to secure supplies and to execute the humane objects contemplated by the said treaty, with the power to adopt and use the distinctive flag and badge specified by the said treaty in Article 7, on which shall be the sign of the Red Cross, and for the purpose of co-operating with the " Comité International de Secours aux Militaires Blessés" ; and whereas it is expedient that the existing association in Canada should be incorporated for the purposes aforesaid: Therefore His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:—

And Whereas, except as to such Reserves, the said territories were by the said treaties freed, for the ultimate benefit of the Province of Ontario, of the burden of the Indian rights, and became subject to be administered by the Government of the said Province for the sole benefit thereof;
Et considérant que, sauf quant à ces réserves, lesdits territoires étaient par lesdits traités exemptés, au bénéfice ultime de la province d’Ontario, de la charge des droits des sauvages, et devenaient sujets à être administrés par le gouvernement de ladite province pour son seul bénéfice;

Whereas the unilateral decision by the State Government of North Dakota to divert waters from Devils Lake into the Sheyenne River and eventually Lake Winnipeg contravenes the Boundary Waters Treaty between Canada and the United States of America; And whereas, such a contravention would set precedent for future negotiations under the said treaty; And whereas such negotiations should most properly be reviewed by the International Joint Commission; And whereas this review has not taken place; And whereas the Devils Lake Diversion project is scheduled to begin operations in July, 2005; And whereas the said water diversion may have serious and harmful ecological and economic repercussions in Canada; Be it resolved that the Standing Committee on the Environment & Sustainable Development urgently calls upon the Government of Canada to immediately exhaust any and all diplomatic and/or legal options available to prevent any water diversion from Devils Lake, North Dakota until the project has been reviewed by the International Joint Commission.
Attendu que la décision unilatérale prise par l’État du Dakota du Nord en vue de détourner les eaux du Devils Lake dans la rivière Sheyenne et éventuellement le lac Winnipeg contrevient au Traité des eaux limitrophes conclu entre le Canada et les États-Unis d’Amérique; Attendu que cette contravention créerait un précédent lors de futures négociations aux termes dudit Traité; Attendu que c’est la Commission mixte des eaux internationales qui serait la mieux placée pour examiner ces négociations; Attendu que cet examen n’a pas eu lieu; Attendu que le projet de détournement des eaux du Devils Lake doit débuter au mois de juillet 2005; Et attendu que ce détournement pourrait avoir des effets graves et néfastes au Canada sur les plans écologique et économique; Il est résolu que le Comité permanent de l'environnement et du développement durable demande de toute urgence au gouvernement du Canada d’épuiser tous les recours diplomatiques et/ou juridiques possibles pour empêcher le détournement des eaux du Devils Lake, au Dakota du Nord, jusqu’à ce que le projet ait été examiné par la Commission mixte des eaux internationales.

The criterion on the government budgetary position referred to in the second indent of Article 140(1) of the said Treaty shall mean that at the time of the examination the Member State is not the subject of a Council decision under Article 126(6) of the said Treaty that an excessive deficit exists.

As a transitional measure, and with respect to acts of the Union in the field of police cooperation and judicial cooperation in criminal matters which have been adopted before the entry into force of the Treaty of Lisbon, the powers of the institutions shall be the following at the date of entry into force of that Treaty: the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union shall not be applicable and the powers of the Court of Justice of the European Union under Title VI of the Treaty on European Union, in the version in force before the entry into force of the Treaty of Lisbon, shall remain the same, including where they have been accepted under Article 35(2) of the said Treaty on European Union.

The Conference declares that the reference in Article 352(1) of the Treaty on the Functioning of the European Union to objectives of the Union refers to the objectives as set out in Article 3(2) and (3) of the Treaty on European Union and to the objectives of Article 3(5) of the said Treaty with respect to external action under Part Five of the Treaty on the Functioning of the European Union.
