The overall amount to be set aside by a phonogram producer for payment of the annual supplementary remuneration referred to in paragraph 2b shall correspond to 20 % of the revenue which the phonogram producer has derived, during the year preceding that for which the said remuneration is paid, from the reproduction, distribution and making available of the phonogram in question, following the 50th year after it was lawfully published or, failing such publication, the 50th year after it was lawfully communicated to the public.

For the purpose of pursuing the Community's said objectives it would appear necessary to provide for Community arrangements for trade marks whereby undertakings can by means of one procedural system obtain Community trade marks to which uniform protection is given and which produce their effects throughout the entire area of the Community.

As regards prolonging the aid payments, that is a decision to be taken later, but that is not the subject of this report which, as I said, is about prolonging the financing of the Community Tobacco Fund and not about prolonging aid payments to tobacco producers in the immediate and foreseeable future.

A great deal has been said from various quarters about the point at which the regulation is to enter into force, and I can assure you that the German Presidency has the greatest possible interest in getting this to happen as soon as possible, but the simple fact of the matter is that a number of formal steps have to be completed between today’s vote and the publication in the Official Journal; first of all, your resolution must be communicated to the Council, which must then come to a policy agreement on it – this will happen on 7 June – and then the versions of it in various languages must be produced – which will happen in the second week of June – then, in the third week of that month, the lawyer-linguists in all the institutions must read through it again, after which COREPER and the Council must formally adopt it, so that a great deal of effort will be required to get it published on 29 June.

During the marketing years 2006/2007, 2007/2008, 2008/2009 and 2009/2010, the intervention agency appointed by each sugar-producing Member State shall be required, in accordance with the procedure referred to in Article 39(2), to purchase the white sugar and raw sugar produced under quota and manufactured from sugar beet and sugar cane harvested in the Community that is offered to it, subject to prior conclusion of a storage contract between the seller and the said agency for the sugar in question.
