On 25 March 2011 the European Council adopted Decision 2011/199 providing for the addition to the Treaty on the Functioning of the European Union (TFEU), of a new provision whereby the Member States whose currency is the euro may establish a stability mechanism to be activated if indispensable to safeguard the stability of the euro area as a whole.
Le Conseil européen a adopté, le 25 mars 2011, la décision 2011/199 prévoyant l’ajout au traité sur le fonctionnement de l’Union européenne (TFUE) d’une nouvelle disposition selon laquelle les États membres, dont la monnaie est l’euro, peuvent instituer un mécanisme de stabilité qui sera activé si cela est indispensable pour préserver la stabilité de la zone euro dans son ensemble.

A European Stability Mechanism has been set up to assist euro area countries with limited access to financial markets; a Compact for Growth and Jobs – including a €120 billion investment package – was adopted by the European Council in June; new rules to strengthen economic governance, notably within the euro area, are being implemented (the "six pack" legislation), have been agreed (the Treaty on Stability, Coordination and Governance) or are almost agreed (the "two pack"); the European Central Bank has taken important measures to safeguard financial stability in the euro area; and ambitious steps are being considered to reinforce the Economic and Monetary Union (EMU), which are set out in the Blueprint for a deep and genuine EMU.

While the primary objective of the EU’s monetary policy is maintaining price stability, the ESM pursues an objective which is clearly distinct, namely to safeguard the stability of the euro area as a whole.

(2) On 25 March 2011, the European Council adopted Decision 2011/199/EU amending Article 136 of the Treaty on the Functioning of the European Union with regard to a stability mechanism for Member States whose currency is the euro adding the following paragraph to Article 136: "The Member States whose currency is the euro may establish a stability mechanism to be activated if indispensable to safeguard the stability of the euro area as a whole.

The non-interest-bearing deposit should be released upon correction of the excessive deficit, while the interest on such deposits and the fines collected should be assigned to stability mechanisms to provide financial assistance, created by Member States whose currency is the euro in order to safeguard the stability of the euro area as a whole.

On 16 December 2010, the Belgian Government submitted, in accordance with Article 48(6), first subparagraph, of the TEU, a proposal for revising Article 136 of the TFEU by adding a paragraph under which the Member States whose currency is the euro may establish a stability mechanism to be activated if indispensable to safeguard the stability of the euro area as a whole and stating that the granting of any required financial assistance under the mechanism will be made subject to strict conditionality.

The measures include broadening the authority of the Minister of Finance to promote financial stability and maintain efficient and well-functioning markets; providing the Canada Deposit Insurance Corporation with greater flexibility to enhance its ability to safeguard financial stability in Canada; and, more important, the government's economic action plan built on these measures through both a task force on financial literacy and landmark new consumer-friendly improvements in areas such as the provision of clear and simple summary information on credit card application forms and contracts.

The Commission announced in its Communication of 29 October 2008 entitled ‘From financial crisis to recovery: A European framework for action’, that it had set up a group of experts, chaired by Mr Jacques de Larosière (the de Larosière Group), to consider the organisation of European financial institutions to ensure prudential soundness, the orderly functioning of markets and stronger European cooperation on financial stability oversight, early warning mechanisms and crisis management, including the management of cross-border and cross-sectoral risks, and also to look at cooperation between the European Union and other major jurisdictions to help safeguard financial stability at the global level.
