26. Congratulates Romania on adopting a substantial body of social welfare legislation, increasing public spending in that area, and adopting a social programme for 2003 and 2004 aimed at fostering solidarity; at the same time stresses that Romania should take more rigorous measures than hitherto to create opportunities for new business start-ups in the country as a basis for future prosperity; and urges Romania to continue the reform of the social security and welfare system, particularly with regard to improving health services, including a comprehensive reform of mental health care and ensuring the social inclusion of people with disabilities;
26. félicite la Roumanie pour l'adoption d'un volume important de législation sur la protection sociale, l'augmentation des dépenses publiques dans ce domaine et l'adoption d'un programme social pour 2003-2004, qui vise à encourager la solidarité; dans le même temps, souligne que la Roumanie devrait adopter des mesures plus fortes que jusqu'à présent pour permettre les nouvelles créations d'entreprises dans le pays, qui sont le fondement de la prospérité future; et encourage la Roumanie à poursuivre la réforme du système de protection sociale, notamment en ce qui concerne l'amélioration des services de santé, y compris une réforme globale des soins psychiatriques et des mesures visant à l'intégration sociale des personnes handicapées;

Points out to Romania that, in addition, a specific safeguard measure could be invoked in relation to it - and, for that matter, in relation to Bulgaria - whereby the Commission, were it to consider that there existed a serious risk that Romania might not be able to fulfil the obligations deriving from accession, especially as regards implementation of the acquis and compliance with the Copenhagen political criteria, could recommend that the Council, acting unanimously, put back its accession by one year; the accession of Romania must be accomplished on merit and on the strength of its performance;

Notes that corruption remains a source of serious concern; is alarmed, in this context, at the Commission's assessment that the number of successful prosecutions for corruption in Romania remains low, especially for high-level corruption; calls on the Romanian Government to step up its efforts to fight corruption, focusing especially on high-level corruption; calls on Romania to make further efforts to confer greater responsibility on the Corruption Enforcement Office and to guarantee its independence and effectiveness; welcomes Romania's positive response to the European Parliament's call to increase the staffing levels of the National Anti-Corruption Prosecutor's Office and her positive participation thus far in the Council of Europe's Group of States against corruption (GRECO), and urges her to make further moves in this direction;

30. Points out that under the Phare Programme EUR 2.286 billion were allocated to Romania during the 1992 to 2003 period and EUR 356.9 million have been foreseen for 2004; under the Sapard Programme EUR 162.2 million were allocated to Romania in 2003 and EUR 168.4 million have been foreseen for 2004; under the ISPA Programme EUR 55.1 million were allocated in 2003 and EUR 451.2 million will be distributed to Romania and Bulgaria in 2004; is concerned that large parts of these pre-accession aid funds will be lost if the absorption rate cannot be considerably increased, in particular for the Sapard Programme, where implementation of funds was only 33% in 2003; welcomes the fact that improvements in the country's administrative capacity to programme, manage and control the Community's pre-accession funds have been made; underlines the necessity for continuous further efforts in order to realise an improvement in the programming, implementation and financial management and control of the European funds;

32. Calls on Romania to substantially increase its legislative alignment in the area of regional policy and structural instruments and to make more efforts to have the adequate administrative infrastructure at all levels to implement the Regional and Structural Funds; reminds Romania that having the instruments in place is indispensable for Romania to benefit from the substantial funds after but also from the pre-accession funds prior to accession;
32. invite la Roumanie à accroître nettement son alignement législatif dans le domaine de la politique régionale et des instruments structurels et à faire davantage d'efforts pour disposer de l'infrastructure administrative adéquate à tous les niveaux pour mettre en œuvre les fonds régionaux et structurels; rappelle à la Roumanie qu'il lui est indispensable de disposer des instruments adéquats pour bénéficier des importants fonds qui lui seront octroyés après l'adhésion, mais aussi pour bénéficier au préalable des fonds de préadhésion;
