This solution, among other things, reflects the point n. 34. of the Report of the European Parliament of 25 November 2011 on modernisation of customs (2011/2083(INI)), that “Calls on the Commission to include in the MCC more rigorous requirements for the provision of the EU’s customs representation services, helping to increase the level of professionalism and ownership on the part of these intermediaries and laying down clear rules to guide relations between customs agents and forwarding undertakings, so as to change the role of the agents to that of consolidators for small and medium-sized importers that do not have the capacity to implement customs compliance programmes similar to those of European AEOs”.

Acknowledges that customs are of vital importance to international trade; appreciates, in this regard, the regulatory role of the WTO agreement on customs valuation that aims for a fair, uniform and neutral system for the valuation of goods for customs purposes, outlawing the use of arbitrary or fictitious customs values that can constitute a barrier to open and fair trade; stresses also that well functioning customs are essential to the competitiveness of the European Union as they play a unique role in combating the illegal import, export and transit of goods and counterfeited products, in protecting intellectual property rights, and in guaranteeing product safety;

The completion of the internal market, the reduction of barriers to international trade and investment and the reinforced need to ensure security and safety at the external borders of the Community have transformed the role of customs authorities giving them a leading role within the supply chain and, in their monitoring and management of international trade, making them a catalyst to the competitiveness of countries and companies.
L’achèvement du marché intérieur, la réduction des entraves aux échanges et aux investissements internationaux et la nécessité accrue d’assurer la sécurité et la sûreté aux frontières extérieures de la Communauté ont transformé le rôle des autorités douanières, en leur faisant jouer un rôle central dans la chaîne logistique et en leur conférant, dans le suivi et dans la gestion du commerce international, une mission de catalyseur de la compétitivité des pays et des entreprises.

Where, in respect of the same goods, controls other than customs controls are to be performed by competent authorities other than the customs authorities, customs authorities shall, in close cooperation with those other authorities, endeavour to have those controls performed, wherever possible, at the same time and place as customs controls (one-stop-shop), with customs authorities having the coordinating role in achieving this.

Since the new role of customs authorities implies the sharing of responsibilities and cooperation between inland and border customs offices, the customs debt should, in most cases, be incurred at the place where the debtor is established, as the customs office competent for that place can best supervise the activities of the person concerned.
