In this framework, the Commission found that since achieving candidate status in 2005 the former Yugoslav Republic of Macedonia has consolidated the functioning of its democracy and ensured the stability of institutions guaranteeing the rule of law and respect of fundamental rights, although of course these efforts need to continue.

Reiterates its concern regarding restrictions on Internet content, whether they apply to the dissemination or to the receipt of information, that are imposed by governments and are not in strict conformity with the guarantee of freedom of expression; in this respect, requests the Council and the Commission to draw up Community rules on trade with third countries concerning goods, including software, hardware and other similar items, the sole purpose of which is to conduct general surveillance activities and to restrict access to the Internet in a manner inconsistent with freedom of expression, and the import and export of such goods, with the exception of goods the sole purpose of which is the protection of children; considers that the same should apply as regards surveillance and/or military technology destined for countries which are systematic violators of human rights; calls also for concrete solutions to be found in order to prevent European businesses from providing those countries with personal data that may be used to violate such rights, particularly freedom of expression;

1. Without prejudice to Chapter 2 of Title IV of Commission Regulation (EC) No 800/1999, where it is found that a document presented by a tenderer for the attribution of the rights deriving from this Regulation provides for incorrect information and where the incorrect information concerned is decisive for the attribution of that right, the competent authorities of the Member State shall exclude the tenderer from participating in the scheme of granting export refunds through a tendering procedure for the products covered by the procedure in question, for a period of one year from the moment when a final administrative decision establishing the irregularity has been made.

Sans préjudice du chapitre 2 du titre IV du règlement (CE) no 800/1999, lorsqu’il est établi qu’un document présenté par un soumissionnaire en vue de l’attribution des droits découlant dudit règlement contient des informations incorrectes et lorsque ces dernières sont déterminantes pour l’attribution de ce droit, les autorités compétentes de l’État membre excluent le soumissionnaire, pendant une période d'un an à compter du moment où une décision administrative finale constatant l'irrégularité a été arrêtée, de la participation au régime d'octroi des restitutions à l'exportation dans le cadre d'une procédure d'adjudication pour les produits couverts par l'adjudication.

The German constitutional court found that the rules governing access to and the use of the data, as laid down in national law, were unconstitutional.[43] The Romanian constitutional court found that data retention per se breached Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) and was thus unconstitutional.[44] The Commission is currently evaluating this instrument and is to submit its assessment report to the European Parliament and the Council in late 2010.
La Cour constitutionnelle allemande a estimé que les dispositions régissant l’accès aux données ainsi que leur utilisation, telles que figurant dans la législation nationale, étaient anticonstitutionnelles[43]. La Cour constitutionnelle roumaine a jugé que la conservation de données était en soi contraire à l’article 8 de la convention de sauvegarde des droits de l'homme et des libertés fondamentales (convention européenne des droits de l’homme) et était donc anticonstitutionnelle[44]. La Commission procède actuellement à l’évaluation de cet instrument et doit présenter son rapport d’évaluation au Parlement européen et au Conseil à la fin 2010.
