Over the past years, Hungary adopted several laws – some of them so-called cardinal laws adopted directly under its new constitution – which raised important fundamental rights concerns and also came under the scrutiny of the Council of Europe.

When term 17 was last before this House, Cardinal Carter of the Toronto Archdiocese wrote to the Prime Minister. This is a good quote from the letter: “The amendment process under the Constitution requires your government to play the role of guardian of minority rights, and if your government rubber stamps an amended term 17, how can it in principle resist similar requests from voting majorities in Alberta, Quebec and Ontario?” He asks: “Would French language rights survive outside of Quebec if they were subject to a referendum?” He goes on to say again: “There is a natural reality that occurs because of population imbalance and that is why minority rights have to be protected in the Constitution of Canada”.

D. whereas the adoption of the cardinal laws raised concerns in a number of fields, notably the independence of the judiciary, the independence of the central bank, the independence of the data protection authority, fair conditions of political competition and political alternation, as well as the so-called stability law subjecting the income tax system to a two-thirds majority and the cardinal laws giving exclusive right to the current majority to appoint officials for an unusually long term, thus affecting the ability of future governments to govern;

Calls on the Hungarian authorities to address the numerous and serious issues, concerns and recommendations raised by the Venice Commission in its opinions and to implement them either via amendments to the Constitution, cardinal laws, ordinary laws, constitutional interpretation, as indicated by the Commission; fully shares the Venice Commission criticism on the vagueness of the Constitution in key sectors such as the judiciary and individual fundamental rights and on the high number of cultural, religious, moral, socio-economic and financial policies that will be cemented via cardinal laws by a 2/3 majority, while they should be left to the majority vote of the elected legislature; agrees on the Commission remarks on the Preamble in relation to the interpretation of the Constitution;

Third, regarding Schengen, all Heads of State and Government are deeply committed to free movement of persons: it is a cardinal achievement of the European integration and a fundamental right of citizens.
