TRADUCTIONS EN CONTEXTE

If the party against whom enforcement is sought did not enter an appearance in the proceedings leading to judgment, it may apply to the courts of the Member State of origin to review the judgment on the ground that either (a) it was not served with the document instituting the proceedings in sufficient time and in such a way as to enable it to arrange for its defence, or (b) it was prevented from contesting the claim owing to “force majeure or extraordinary circumstances without any fault on his part”, unless it failed to challenge the judgment when it was possible for it to do so.
Si la partie contre laquelle l'exécution est demandée n'a pas comparu à la procédure ayant mené au jugement, elle peut saisir les tribunaux de l'État membre d'origine d'une demande de révision du jugement aux motifs que a) l'acte introductif d'instance ne lui a pas été notifié ou signifié en temps utile et de telle manière à ce qu'elle puisse se défendre; ou b) elle a été empêchée de contester la créance "pour cause de force majeure ou en raison de circonstances extraordinaires, sans qu'il y ait faute de sa part", à moins qu’elle n’ait pas exercé de recours à l’encontre de la décision alors qu’elle était en mesure de le faire.

The judgment under appeal infringes Article 107(1) TFEU in that it does not carry out a comprehensive review as to whether the conditions laid down in the judgment in Régie Networks (3) in order for the tax imposed on DTS to be regarded as an integral part of the aid to RTVE are satisfied and in that it distorts Spanish law.
L’arrêt faisant l’objet du pourvoi viole l’article 107, paragraphe 1, TFUE en ce qu’il n’exerce pas un contrôle complet relatif au respect des conditions prévues dans l’arrêt Régie Networks (3) pour que la taxe imposée à DTS puisse être considérée comme faisant partie intégrante d’une mesure d’aide à la RTVE et en ce qu’il dénature le droit espagnol.
