More specifically, the Council adopted a decision extending for a further year, until 20 February 2012, restrictive measures first imposed in 2002 owing to concerns about violence and human rights abuses perpetrated by the regime in Zimbabwe (6102/11 + 5989/11).

The bill restricts the rights of these foreign nationals who want to receive permanent resident status in Canada by means of the following measures: first, the right of an officer or the minister to reject an application for permanent residence from a designated foreign national; second, the power to detain a permanent resident or a foreign national because there are reasonable grounds to suspect that the person concerned is inadmissible on grounds of serious criminality or organized criminality; third, detention rules and a review procedure that are specific to the detention of certain designated foreign nationals; fourth, the provision stating that a person cannot become a permanent resident as long as an application by the minister for cessation of that person's refugee protection is pending; fifth, for the purposes of determining the penalty for certain offences, the addition to the list of aggravating factors of the fact that, as a result of the offence committed, the life or safety of any person was endangered; and, lastly, the extension of the time for instituting proceedings by way of summary conviction from six months to five years.

The restrictive measures, first introduced in February 2002, consist of a ban on entry into the EU and a freeze on financial assets for individuals who engage in activities which seriously undermine democracy, respect for human rights and the rule of law in Zimbabwe.

In this connection a recent judgment by the Court of Justice in Luxembourg (25 July 1991) concerning the Dutch law on the media for the first time clearly enunciates the principle that cultural policy is an objective of general interest. This means that the Member States can adopt measures constituting restrictions on programmes originating in other Member States on four conditions: - that the measures do not fall within the areas already covered by the "television without frontiers" Directive; - that such measures are non-discriminatory, namely they must apply to national broadcasters and foreign broadcasters alike; - that the measures are commensurate with the objective (i.e. cultural policy); and - that a less restrictive measure is not already in force.
A cet égard, un récent arrêt de la Cour de Justice de Luxembourg (du 25 juillet dernier) concernant la loi néerlandaise sur les médias pose clairement pour la première fois, le principe que la politique culturelle est un objectif d'intérêt général, ce qui signifie que les Etats membres peuvent prendre des mesures constituant des restrictions à l'égard des programmes originaires d'autres Etats membres sous la quadruple condition que : - ces mesures ne tombent pas dans le champ d'application des domaines déjà coordonnés par la directive "Télévision sans frontières"; - que de telles mesures soient non discriminatoires c'est-à-dire qu'elles s'appliquent aux radiodiffuseurs nationaux au même titre qu'aux diffuseurs étrangers; - que ces mesures soient proportionnées à l'objectif légitime poursuivi (cfr. une politique culturelle); - enfin, qu'il n'existe pas de mesure moins entravante en termes de restriction à la libre circulation de la production audiovisuelle.

The adoption of restrictive measures was made possible by the distinction made in the contract establishing the Groupement between the major banks that are members of its Board of Directors and the other members (which include the banking arms of large retailers such as Carrefour and Auchan, and Internet banks). Only Board members can adopt price measures without needing first to consult or inform the other members or obtain their votes in support of the measures.
