− having regard to a request for the defence of the immunity of Mr Marco Pannella, following his sentencing to a term of imprisonment, - subsequently commuted to an order restricting his freedom of movement - for acts which took place in Italy, as submitted by Mr Maurizio Turco on 29 April 2003 and communicated to Parliament, meeting in plenary, on 4 June 2003,

As a consequence of that action, Mr Pannella was convicted of the offence of flagrantly supplying narcotic substances and was definitively sentenced to four months' imprisonment, subsequently converted into an order restricting his freedom of movement for eight months, which he has been serving in accordance with the conditions laid down by the Supervising Judge in Rome, entailing authorisation to 'travel to the offices in Brussels, Strasbourg and Luxembourg to perform his duties as a Member of the European Parliament, subject to prior notice to the police authorities, for the time strictly needed for the same and in no circumstances for more than seven days for each month of the sentence'.
2. À la suite de cette action, M. (1) both parties to the agreement or their connected undertakings are motor vehicle manufacturers; or (2) the parties link their agreement to stipulations concerning products or services other than those referred to in this Regulation or apply their agreement to such products or services; or (3) in respect of motor vehicles having three or more road wheels, spare parts or services therefor, the parties agree restrictions of competition that are not expressly exempted by this Regulation; or (4) in respect of motor vehicles having three or more road wheels or spare parts therefor, the parties make agreements or engage in concerted practices which are exempted from the prohibition in Article 85 (1) of the Treaty under Regulations (EEC) No 1983/83 or (EEC) No 1984/83 to an extent exceeding the scope of this Regulation; or (5) the parties agree that the supplier reserves the right to conclude distribution and servicing agreements for contract goods with specified further undertakings operating within the contract territory, or to alter the contract territory; or (6) the manufacturer, the supplier or another undertaking directly or indirectly restricts the dealer's freedom to determine prices and discounts in reselling contract goods or corresponding goods; or (7) the manufacturer, the supplier or another undertaking within the network directly or indirectly restricts the freedom of final consumers, authorized intermediaries or dealers to obtain from an undertaking belonging to the network of their choice within the common market contract goods or corresponding goods or to obtain servicing for such goods, or the freedom of final consumers to resell the contract goods or corresponding goods, when the sale is not effected for commercial purposes; or (8) the supplier, without any objective reason, grants dealers remunerations calculated on the basis of the place of destination of the motor vehicles resold or the place of residence of the purchaser; or (9) the supplie ...

( 8 ) WHEREAS THIS REGULATION MUST DEFINE THE OBLIGATIONS RESTRICTING COMPETITION WHICH MAY BE INCLUDED IN EXCLUSIVE DISTRIBUTION AGREEMENTS ; WHEREAS THE OTHER RESTRICTIONS ON COMPETITION ALLOWED UNDER THIS REGULATION IN ADDITION TO THE EXCLUSIVE SUPPLY OBLIGATION PRODUCE A CLEAR DIVISION OF FUNCTIONS BETWEEN THE PARTIES AND COMPEL THE EXCLUSIVE DISTRIBUTOR TO CONCENTRATE HIS SALES EFFORTS ON THE CONTRACT GOODS AND THE CONTRACT TERRITORY ; WHEREAS THEY ARE , WHERE THEY ARE AGREED ONLY FOR THE DURATION OF THE AGREEMENT , GENERALLY NECESSARY IN ORDER TO ATTAIN THE IMPROVEMENT IN THE DISTRIBUTION OF GOODS SOUGHT THROUGH EXCLUSIVE DISTRIBUTION ; WHEREAS IT MAY BE LEFT TO THE CONTRACTING PARTIES TO DECIDE WHICH OF THESE OBLIGATIONS THEY INCLUDE IN THEIR AGREEMENTS ; WHEREAS FURTHER RESTRICTIVE OBLIGATIONS AND IN PARTICULAR THOSE WHICH LIMIT THE EXCLUSIVE DISTRIBUTOR'S CHOICE OF CUSTOMERS OR HIS FREEDOM TO DETERMINE HIS PRICES AND CONDITIONS OF SALE CANNOT BE EXEMPTED UNDER THIS REGULATION ;
(8) considérant que le présent règlement doit déterminer les restrictions à la concurrence qui peuvent figurer dans un accord de distribution exclusive ; que les restrictions de concurrence qui, outre l'engagement de livraison exclusive, sont ainsi admises conduisent à une répartition claire des tâches entre les parties et obligent le concessionnaire exclusif à concentrer ses activités commerciales sur les produits visés au contrat et sur le territoire concédé ; que ces restrictions, dans la mesure où elles sont convenues uniquement pour la durée de l'accord, sont en règle générale nécessaires pour obtenir les améliorations de la distribution recherchées par l'octroi d'une concession exclusive de vente ; que l'on peut laisser aux parties le soin de décider quelles sont celles de ces dispositions qu'elles inséreront dans leurs accords d'exclusivité ; que d'autres dispositions restrictives de la concurrence, et en particulier celles qui limitent la liberté du concessionnaire exclusif de déterminer ses prix et ses conditions de revente, ou de choisir ses clients, ne peuvent pas être exemptées au titre du présent règlement;

( 8 ) WHEREAS THIS REGULATION MUST DEFINE THE OBLIGATIONS RESTRICTING COMPETITION WHICH MAY BE INCLUDED IN AN EXCLUSIVE PURCHASING AGREEMENT ; WHEREAS THE OTHER RESTRICTIONS OF COMPETITION ALLOWED UNDER THIS REGULATION IN ADDITION TO THE EXCLUSIVE PURCHASING OBLIGATION LEAD TO A CLEAR DIVISION OF FUNCTIONS BETWEEN THE PARTIES AND COMPEL THE RESELLER TO CONCENTRATE HIS SALES EFFORTS ON THE CONTRACT GOODS ; WHEREAS THEY ARE , WHERE THEY ARE AGREED ONLY FOR THE DURATION OF THE AGREEMENT , GENERALLY NECESSARY IN ORDER TO ATTAIN THE IMPROVEMENT IN THE DISTRIBUTION OF GOODS SOUGHT THROUGH EXCLUSIVE PURCHASING ; WHEREAS FURTHER RESTRICTIVE OBLIGATIONS AND IN PARTICULAR THOSE WHICH LIMIT THE RESELLER'S CHOICE OF CUSTOMERS OR HIS FREEDOM TO DETERMINE HIS PRICES AND CONDITIONS OF SALE CANNOT BE EXEMPTED UNDER THIS REGULATION ;
