Further to the second subparagraph of Article 113(3) and without prejudice to any specific provisions which may be adopted by the Commission in accordance with Article 194, in particular on the consistent application in the Member States of the conformity checks, Member States shall, in respect of the fruit and vegetables and the processed fruit and vegetables sectors, check selectively, based on a risk analysis, whether the products concerned conform to the respective marketing standards.

Points out that many Mediterranean countries have expressed the wish to preserve their trade preferences vis-à-vis the Community market; considers that maintaining this preferential and asymmetric system is incompatible with a general liberalisation of the agriculture sector; emphasises, furthermore, that it is in the mutual interest of all Mediterranean countries to preserve certain tools with which to manage supply on their respective markets; calls accordingly on the Commission and the representatives of the SEMC to seek in the course of the multilateral trade negotiations being conducted within the World Trade Organisation (WTO) any possible means (including the classification of milk, fruit and vegetables as sensitive products) of limiting market imbalances and also any possible asymmetry and distortion of competition between the agricultural markets in the SEMC and those in the EU which might cause farmers in either group of countries to suffer loss;
8. rappelle que de nombreux pays méditerranéens ont exprimé le souhait de conserver leurs préférences commerciales vis-à-vis du marché communautaire; estime que le maintien de ce système préférentiel et asymétrique est incompatible avec une libéralisation généralisée du secteur agricole; souligne, en outre, l'intérêt réciproque pour l'ensemble des pays du bassin méditerranéen de conserver certains outils de gestion de l'offre sur leurs marchés respectifs; demande en ce sens à la Commission et aux représentants des PSEM de rechercher, dans le cadre des négociations multilatérales sur les échanges, au sein de l'Organisation mondiale du commerce (OMC), toutes les solutions possibles, dont la qualification du lait, des fruits et légumes en produits sensibles, pour limiter les déséquilibres de marché mais également toutes les asymétries et distorsions de concurrence éventuelles entre les marchés agricoles des pays du sud et de l'est de la Méditerranée et ceux de l'Union européenne, qui pourraient porter préjudice aux agriculteurs de ces deux groupes de pays;

For the purposes of determining the most relevant market where the turnover of the instrument is highest, each competent authority that has authorised one of the regulated markets concerned shall calculate the turnover for that instrument in its respective market for the previous calendar year, provided that the instrument was admitted to trading at the beginning of that year.
