The multi annual Thematic Strategy Paper will define more detailed priorities for action in these different areas taking into account geographic programmes but without providing a very rigid framework, in order to respect actors’ right of initiative by supporting their own initiatives.

K. whereas the rule of law, as one of the fundamental principles of the EU, implies not only respect for democracy and human rights, but also compliance with international law, the assurance that the law is fairly enforced and applied, as well as the independence and impartiality of the judiciary; whereas these conditions are not met in Russia, where the authorities fail to uphold the rule of law and to respect fundamental rights, and where political rights, civil liberties and media freedom have deteriorated in recent years; whereas legislation has recently been passed with ambiguous provisions that are used to place further restrictions on opposition and civil-society actors; whereas the recent adoption of the law criminalising so-called ‘homosexual propaganda’ has led to an increase in homophobic and anti-LGBTI violence and hate speech, which the authorities have failed to address; whereas, following the illegal annexation of Crimea, respect for human rights, including freedom of expression, assembly and association, has suffered a serious deterioration in the peninsula, the Crimean Tartar community being particularly affected;

National judges are key actors in giving concrete effect to the rights and freedoms enshrined in the Charter, as they directly ensure that individuals obtain full redress in cases where fundamental rights within the scope of EU law have not been respected.

The EU should also encourage other global actors, such as multinational corporations (MNCs), to play a full part in increasing respect for human rights world-wide and to use their often considerable influence within a developing country to support rather than undermine that country's own efforts to achieve sustainable development.

17. Welcomes the holding, on the initiative of Nigeria and the United States, of the 14th Special Session on the situation of human rights in Cote d'Ivoire in relation to the conclusion of the 2010 presidential election, which condemned human rights violations and called on all parties to fully respect human rights and fundamental freedoms and the rule of law; reiterates its support for the outcome of elections as recognised by the UN and calls on all actors to recognise the authority of Alassane Ouattara as elected president; supports the decision of the African Union to set up a panel of Heads of State to bring about a peaceful and negotiated settlement to the post-election crisis in Ivory Coast;
