Action under Article 25(5) of the Convention concluded between the Republic of Austria and the Federal Republic of Germany concerning the avoidance of double taxation with respect to taxes on income and capital (öBGBl III 182/2002, dBGBl II 2002, 735, and dBStBl I 2002, 584) (‘the German-Austrian Double Taxation Convention’), read in conjunction with Article 273 TFEU, concerning discrepancies between the Republic of Austria and the Federal Republic of Germany in their views on the interpretation and application of Article 11 of that Convention.
Recours fondé sur l’article 25, paragraphe 5, de la Convention entre la République d’Autriche et la République fédérale d’Allemagne, préventive de la double imposition en matière d’impôt sur le revenu et sur la fortune, öBGBl III 182/2002 et dBGBl II 2002, 735, dBStBl I 2002, 584, en combinaison avec l’article 273 TFUE, du fait d’une divergence de position entre la République d’Autriche et la République fédérale d’Allemagne en ce qui concerne l’interprétation et l’application de l’article 11 de ladite convention.

(a) by the Federal Republic of Germany, the revenue claim shall be enforced by the Federal Republic of Germany in the same way as a revenue claim under Federal Republic of Germany laws against the taxpayer as of the time the application is received; and

set aside the judgment of the General Court of the European Union of 21 November 2012 in Case T-270/08 Federal Republic of Germany, Kingdom of Spain (intervener), French Republic (intervener), Kingdom of the Netherlands (intervener) v European Commission, concerning the annulment of Commission Decision C(2008) 1615 final of 29 April 2008 reducing the financial contribution under the European Regional Development Fund (ERDF) initially granted for the Operational Programme falling under Objective 1 (1994-1999) for Berlin (East) in the Federal Republic of Germany, and annul the aforementioned decision of the Commission;

It was on February 13, 1990, during the Open Skies Conference here in Ottawa, that an agreement was reached between the foreign ministers of the Free Republic of Germany, the FRG; the then German Democratic Republic, the GDR; the then Union of Soviet Socialist Republic, the U.S.S.R.; France; the United Kingdom; and the United States, on the start of the historic " Two-Plus-Four" talks which led to the fulfilment of Germany's dream to have the country reunited after more than 40 years of division.
