As the European Court of Justice has held on several occasions, in particular, judgement of 26 March 1987 in the case 235/85 "Commission v Kingdom of the Netherlands" and judgements of 12 September 2000 in the cases C-276/97 "Commission v French Republic" and C-359/97 "Commission v United Kingdom of Great Britain and Northern Ireland", it is clear from Article 4(5) of the Directive, when examined in the light of the aims of the Sixth Directive, that two conditions must be fulfilled for the rule of treatment as a non-taxable person to apply: the activities must be carried out by a body governed by public law and they must be carried out by that body acting as a public authority.
