At paragraph 42 of the judgment under appeal, the General Court observed that neither the Court of Appeal’s judgment of 7 May 2008 nor the Home Secretary’s order of 23 June 2008 had an automatic, immediate effect on Council Decision 2007/868/EC of 20 December 2007 implementing Article 2(3) of Regulation No 2580/2001 and repealing Decision 2007/445/EC (OJ 2007 L 340, p. 100), then applicable, that decision remaining in force and legally binding, in accordance with the presumption of legality attaching to acts of the European Union, for so long as it was not withdrawn, declared void in an action for annulment or declared invalid following a reference for a preliminary ruling or a plea of illegality.

The letter stressed that the Commission had used a secondary legal basis, which ‘(...) seems to be illegal in the light of the case law of the Court of Justice (in particular its judgment of 6 May 2008 in case C-133/06)’ and further stated that ‘(...) under the Treaty of Lisbon, the legislative function is now shared between Parliament and the Council and, as Article 202 EC has been repealed, the Council no longer has an autonomous legislative power. With regard to legislative acts in the field of agriculture under Article 43(2) TFEU, it is the ordinary legislative procedure which applies to their adoption’.

13. Reiterates that the 'Helms-Burton' extraterritorial laws and the trade embargo on Cuba are illegal and must be withdrawn; calls on the Council and Commission to raise the matter during the EU-US summit and to work for the repeal of those provisions, if necessary challenging the US in the WTO;

Considers that, despite its imperfections, the Euratom Treaty remains for the time being an indispensable legal framework and no particular changes have been made to it by the present amending Treaty; considers, however, that Protocol No 12 to the amending Treaty, relating to the Euratom Treaty, makes the text illegible and very complicated due to numerous cross-references and the repeal of certain articles of the Euratom Treaty;
