The German Renewable Energy Act (EEG) provides support for the production of renewable electricity.

Where implementing acts provided for in this paragraph define a harmonised date for renewal or reassignment of rights of use of radio spectrum which falls after the date of expiry or renewal of any existing individual rights of use of such radio spectrum in any of the Member States, the national competent authorities shall extend the existing rights until the harmonised date under the same previously applicable substantive authorisation conditions, including any applicable periodic fees.

In its Opening Decision, the Commission stated that the German renewable energy law that had entered into force on 1 April 2000 (‘EEG-Act 2000’), the precursor of the EEG-Act 2012, had been considered not to involve State aid by the Commission (Commission Decision in case NN 27/2000) (75).

The investigation showed that all types of bioethanol are considered to be biofuels under the current National Renewable Fuel Standard program (RFS1) established under the Energy Policy Act of 2005, which amended the Clean Air Act by establishing the first national renewable fuel standard.

(19) In order to ensure the appropriate level and distribution of renewal fees in compliance with the principles set out in this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of the level of the renewal fees for European patents with unitary effect and the distribution of such fees between the European Patent Organisation and the participating Member States.
(19) Afin de garantir un niveau et une répartition appropriés des taxes annuelles conformément aux principes posés par le présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes, conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne, en ce qui concerne le niveau des taxes annuelles afférentes aux brevets européens à effet unitaire et leur répartition entre l'Organisation européenne des brevets et les États membres participants.

With regard to the current German Renewable Energy Act, it should be observed that that measure is not the subject of this Decision; the Commission has not yet made an assessment of it, and consequently cannot enter into detailed consideration of a supposed analogy between the Austrian Green Electricity Act and the current German Renewable Energy Act.
