As a general remark, the Commission recalls that the Directive must be interpreted and applied in accordance with fundamental rights[5], in particular the right to respect for private and family life, the principle of non-discrimination, the rights of the child and the right to an effective remedy as guaranteed in the European Convention of Human Rights (ECHR) and as reflected in the EU Charter of Fundamental Rights.
À titre d'observation générale, la Commission rappelle que la directive doit être interprétée et appliquée conformément aux droits fondamentaux[5], notamment le droit au respect de la vie privée et familiale, le principe de non-discrimination, les droits de l'enfant et le droit à un recours effectif, tels qu'ils sont garantis dans la convention européenne des droits de l'homme (CEDH) et repris dans la charte des droits fondamentaux de l'UE.
