In order to achieve those objectives, this Regulation should bring together provisions on jurisdiction, on applicable law, on recognition or, as the case may be, acceptance, enforceability and enforcement of decisions, authentic instruments and court settlements and on the creation of a European Certificate of Succession.
Afin d'atteindre ces objectifs, le présent règlement devrait regrouper les dispositions sur la compétence, la loi applicable, la reconnaissance — ou, le cas échéant, l'acceptation —, la force exécutoire et l'exécution des décisions, des actes authentiques et des transactions judiciaires ainsi que sur la création d'un certificat successoral européen.

In accordance with the intent stated in the Commission Communication of 29 June 2011 entitled ‘A budget for Europe 2020’, which underlines the commitment of the Union to promote in its internal and external policies smart, inclusive and sustainable growth bringing together the economic, social and environmental pillars, this Regulation should as far as possible contribute to the objective of addressing at least 20 % of the overall Union funding for climate action objectives, while respecting the principle of partnership with ACP countries enshrined in the ACP-EU Partnership Agreement.
Conformément à l'intention exprimée par la Commission dans sa communication du 29 juin 2011, intitulée «Un budget pour la stratégie Europe 2020», qui souligne la détermination de l'Union à promouvoir une croissance intelligente, durable et inclusive dans ses politiques intérieures et extérieures en réunissant les trois piliers des dimensions économique, sociale et environnementale, le présent règlement devrait autant que possible contribuer à l'objectif consistant à consacrer 20 % au moins de l'ensemble du financement de l'Union aux objectifs de l'action pour le climat, tout en respectant le principe de partenariat avec les pays ACP inscrit dans l'accord de partenariat ACP-UE.

(7) In order to achieve those objectives, this Regulation should bring together provisions on jurisdiction, on applicable law, on recognition or, as the case may be, acceptance, enforceability and enforcement of decisions, authentic instruments and court settlements and on the European Certificate of Succession.
(7) Afin d'atteindre ces objectifs, le présent règlement devrait regrouper les dispositions sur la compétence , la loi applicable, la reconnaissance ou, le cas échéant, sur l'acceptation, le caractère exécutoire et l'exécution des décisions, des actes authentiques et des transactions judiciaires ainsi que sur le certificat successoral européen.

(11) The Union is committed in relations with its partners worldwide to promoting sustainable development, free and fair trade and decent work for all along with ratification and effective implementation of the internationally recognised labour standards and multilateral environmental agreements. This Regulation should be used as a tool for supporting international competitiveness and contributing to a reduction in the risk of protectionism, while promoting European values and commercial interests, and as an instrument for free and fair trade that can bring into general practice the effective inclusion and implementation of social and environmental standards with partner countries, including promotion of new forms of employment policies and the creation of jobs meeting International Labour Organization (ILO) decent work standards and growth opportunities for European industries and small and medium-sized enterprises.
(11) L'Union s'est engagée à promouvoir, dans ses relations avec ses partenaires du monde entier, le développement durable, le commerce libre et équitable et le travail décent pour tous ainsi que la ratification et la mise en œuvre effective des normes de travail internationalement reconnues ainsi que des accords multilatéraux sur l'environnement Le présent règlement devrait être utilisé comme un outil susceptible de soutenir la compétitivité internationale et de contribuer à la réduction des risques protectionnistes, tout en œuvrant à la promotion des valeurs et des intérêts commerciaux de l'Europe, mais aussi comme un outil de commerce libre et équitable susceptible de généraliser chez les pays partenaires l'inclusion et la mise en œuvre effectives des normes sociales et environnementales, en ce compris la promotion de nouvelles formes de politiques de l'emploi, de création d'emplois répondant aux normes édictées par l'Organisation internationale du travail (OIT) en matière de travail décent et de débouchés pour l'industrie et les petites et moyennes entreprises européennes.

(16) With a view to strengthened democratic control at Union level, the provisions of this Regulation grant extended powers to committees of inquiry; in order to give effect to those provisions, to increase the efficiency of inquiries and to bring them more in line with national parliamentary practice, this Regulation should provide for the possibility of effective, proportionate and dissuasive sanctions in well-defined cases; it should be up to Member States to ensure that certain infringements are subject to appropriate sanctions under their national law and that they bring appropriate proceedings against the perpetrators of such infringements.
(16) Afin de renforcer le contrôle démocratique au niveau de l'Union, les dispositions du présent règlement accordent aux commissions d'enquête des pouvoirs étendus. Pour donner effet à ces dispositions, améliorer l'efficacité des enquêtes et mieux les aligner sur les pratiques parlementaires nationales, le présent règlement devrait prévoir la possibilité de sanctions efficaces, proportionnées et dissuasives dans des cas bien déterminés; c'est aux États membres qu'il appartiendrait de veiller à ce que certaines infractions soient passibles de sanctions adaptées, prévues par leur droit national, et d'engager les poursuites qu'il convient à l'encontre des auteurs de ces infractions.

13. Considers that the Regulation should contain a new provision dealing with the opposability of choice-of-court agreements against third parties; takes the view that such provision could provide that a person who is not a party to the contract will be bound by an exclusive choice-of-court agreement concluded in accordance with the Regulation only if: (a) that agreement is contained in a written document or electronic record; (b) that person is given timely and adequate notice of the court where the action is to be brought; (c) in contracts for carriage of goods, the chosen court is (i) the domicile of the carrier; (ii) the place of receipt agreed in the contract of carriage; (iii) the place of delivery agreed in the contract of carriage, or (iv) the port where the goods are initially loaded on a ship or the port where the goods are finally discharged from a ship; considers that it should further be provided that, in all other cases, the third party may bring an action before the court otherwise competent under the Regulation if it appears that holding that party to the chosen forum would be blatantly unfair;
(c) dans les contrats de transport de marchandises, la juridiction choisie est celle i) du domicile du transporteur; ii) du lieu de réception convenu dans le contrat de transport; iii) du lieu de livraison convenu dans le contrat de transport ou iv) du port où les marchandises ont été initialement chargées sur le navire ou le port où les marchandises ont finalement été déchargées du navire; estime; par ailleurs, qu'il conviendrait de prévoir que, dans tous les autres cas, le tiers peut engager un recours devant la juridiction qui serait autrement compétente en vertu du règlement s'il apparaît que le maintien de la juridiction choisie exposerait la partie concernée à une injustice flagrante;

(7) Regulation (EC) No 761/2001 demonstrated its effectiveness in promoting improvements of the environmental performance of organisations and the experience gathered from the implementation of that Regulation should be used to enhance the ability of EMAS to bring about an improvement in the overall environmental performance of organisations.
(7) Le règlement (CE) n° 761/2001 s'est révélé efficace pour promouvoir l'amélioration des performances environnementales des organisations; il convient donc de mettre à profit l'expérience acquise grâce à la mise en œuvre de ce règlement pour renforcer la capacité de l'EMAS à améliorer la performance environnementale globale des organisations.

To this effect, the experience gathered from the implementation of that Regulation should be used to enhance the ability of EMAS to bring about an improvement in the overall environmental performance of organisations.
À cet effet, il convient donc de mettre à profit l’expérience acquise dans le cadre de la mise en œuvre de ce règlement pour renforcer la capacité de l’EMAS à améliorer les résultats obtenus de façon globale par les organisations.
