IN-CONTEXT TRANSLATIONS

1. Notwithstanding Article 7 of the implementing Regulation, any institution which establishes, while investigating a claim for benefits, that the claimant is entitled to an independent benefit under the applicable legislation, in accordance with Article 52(1)(a) of the basic Regulation, shall pay that benefit without delay.

(4) In the case of an inconsistency between these Regulations and the Pension Benefits Standards Regulations, 1985, these Regulations shall prevail.

The arrangements for implementing this Regulation shall take into account the results of a cost-benefit analysis and shall relate to the ESSPROS core system, as set out in Annex I, the module on pension beneficiaries, as set out in Annex II and the module on net social protection benefits, as referred to in Article 5.

Les dispositions d'exécution du présent règlement prennent en compte les résultats d'une analyse coûts-bénéfices et concernent le système central de Sespros tel que fixé à l'annexe I, le module sur les bénéficiaires de pension tel que fixé à l'annexe II et le module sur les prestations nettes de protection sociale tel que visé à l'article 5.

11. Without prejudice to the law on the protection of industrial and commercial property, medicinal products for human use which have been authorised in accordance with the provisions of this Regulation shall benefit from an eight-year period of data protection and a ten-year period of marketing protection, in which connection the latter period shall be extended to a maximum of 11 years if, during the first eight years of those ten years, the marketing authorisation holder obtains an authorisation for one or more new therapeutic indications which, during the scientific evaluation prior to their authorisation, are held to bring a significant clinical benefit in comparison with existing therapies.
11. Les médicaments à usage humain autorisés conformément aux dispositions du présent règlement bénéficient, sans préjudice du droit concernant la protection de la propriété industrielle et commerciale, d'une période de protection des données d'une durée de huit ans et d'une période de protection de la mise sur le marché d'une durée de dix ans portée à onze ans au maximum si le titulaire de l'autorisation de mise sur le marché obtient pendant les huit premières années de ladite période de dix ans une autorisation pour une ou plusieurs indications thérapeutiques nouvelles qui sont jugées, lors de l'évaluation scientifique conduite en vue de leur autorisation, apporter un bénéfice clinique important par rapport aux thérapies existantes.

10. Veterinary medicinal products which have been authorised in accordance with the provisions of this Regulation shall benefit from the provisions on protection in Articles 13 and 13a of Directive 2001/82/EC.
10. Les médicaments vétérinaires autorisés conformément au présent règlement bénéficient des dispositions relatives à la protection aux articles 13 et 13 bis de la directive 2001/82/CE.

The actual amount of benefits in kind provided pursuant to Article 19(1) and (2) of the Regulation to employed and self-employed persons and to members of their families residing in the territory of the same Member State, and benefits in kind provided pursuant to Articles 21(2), 22, 22a, 22b, 25(1), (3) and (4), 26, 31, 34a or 34b of the Regulation, shall be refunded by the competent institution to the institution which provided the said benefits as shown in the accounts of that institution".
