1. Save as otherwise provided in this Regulation, the law applicable to insolvency proceedings and their effects shall be that of the Member State within the territory of which such proceedings are opened (the ‘State of the opening of proceedings’).

That is established in a law called the ‘Dublin Regulation’. This law requires us to establish whether we are responsible for examining your application or whether another country is responsible – we call this a ‘Dublin procedure’.

Except where otherwise provided for in this Regulation, Union law on jurisdiction shall apply to disputes involving an EGTC.

allowing provisions in the statutes of an SE adopted by a Member State in execution of authorisations given to the Member States by this Regulation or laws adopted to ensure the effective application of this Regulation in respect to the SE which deviate from or are complementary to these laws, even when such provisions would not be authorised in the statutes of a public limited-liability company having its registered office in the Member State.

( 19 ) WHEREAS TO THE EXTENT THAT MEMBER STATES PROVIDE , BY LAW OR ADMINISTRATIVE MEASURES , FOR THE SAME UPPER LIMIT OF DURATION FOR THE EXCLUSIVE PURCHASING OBLIGATION UPON THE RESELLER AS IN SERVICE-STATION AGREEMENTS LAID DOWN IN THIS REGULATION BUT PROVIDE FOR A PERMISSIBLE DURATION WHICH VARIES IN PROPORTION TO THE CONSIDERATION PROVIDED BY THE SUPPLIER OR GENERALLY PROVIDE FOR A SHORTER DURATION THAN THAT PERMITTED BY THIS REGULATION , SUCH LAWS OR MEASURES ARE NOT CONTRARY TO THE OBJECTIVES OF THIS REGULATION WHICH , IN THIS RESPECT , MERELY SETS AN UPPER LIMIT TO THE DURATION OF SERVICE-STATION AGREEMENTS ; WHEREAS THE APPLICATION AND ENFORCEMENT OF SUCH NATIONAL LAWS OR MEASURES MUST THEREFORE BE REGARDED AS COMPATIBLE WITH THE PROVISIONS OF THIS REGULATION ;
( 19 ) CONSIDERANT QUE DANS LA MESURE OU LES ETATS MEMBRES PRESCRIVENT , PAR VOIE DE DISPOSITIONS OU DE MESURES ADMINISTRATIVES , UNE DUREE MAXIMALE POUR L ' OBLIGATION D ' APPROVISIONNEMENT EXCLUSIF DU REVENDEUR DANS LE CAS DES CONTRATS DE STATIONS-SERVICE QUI EST LA MEME QUE CELLE PREVUE PAR LE PRESENT REGLEMENT TOUT EN PREVOYANT UN ECHELONNEMENT DANS LE TEMPS EN FONCTION DE L ' IMPORTANCE DES PRESTATIONS DU FOURNISSEUR OU EN PRESCRIVANT EN GENERAL UNE DUREE PLUS COURTE QUE CELLE AUTORISEE PAR LE PRESENT REGLEMENT , CES DISPOSITIONS OU MESURES NE SONT PAS EN CONTRADICTION AVEC LES OBJECTIFS DU PRESENT REGLEMENT , QUI NE FAIT QUE FIXER A CET EGARD LA DUREE MAXIMALE DES CONTRATS DE STATIONS-SERVICE ; QUE L ' APPLICATION ET L ' EXECUTION DE CES DISPOSITIONS OU MESURES DE DROIT INTERNE DOIVENT DES LORS ETRE CONSIDEREES COMME COMPATIBLES AVEC LES DISPOSITIONS DU PRESENT REGLEMENT ;
