IN-CONTEXT TRANSLATIONS

‘exchange-traded derivative’ means a derivative that is traded on a regulated market or on a third-country market considered to be equivalent to a regulated market in accordance with Article 28 of this Regulation, and as such does not fall within the definition of an OTC derivative as defined in Article 2(7) of Regulation (EU) No 648/2012.

In order to avoid any gaps or overlaps and to ensure consistency between Regulation (EU) No 648/2012 and this Regulation, the requirements set out in this Regulation on non-discriminatory access between CCPs and trading venues apply to derivatives traded on regulated markets or on a third-country market considered as equivalent to a regulated market in accordance with Directive 2014/65/EU and all non-derivative financial instruments.
Afin d’éviter toute disparité ou tout chevauchement entre le règlement (UE) no 648/2012 et le présent règlement et d’assurer la cohérence entre ceux-ci, les exigences prévues dans le présent règlement concernant l’accès non discriminatoire entre les contreparties centrales et les plates-formes de négociation devraient s’appliquer aux instruments dérivés négociés sur les marchés réglementés ou sur un marché d’un pays tiers considéré comme équivalant à un marché réglementé en vertu de la directive 2014/65/UE, ainsi qu’à tous les instruments financiers non dérivés.
