The first section gives the wider policy background to the Communication; the second focuses on the possible content of the pilot Regional Protection Programmes; the third examines the selection of geographic areas for the application of the pilot Regional Protection Programmes and how this approach can be embedded in Community policy towards the countries and regions concerned; the fourth and fifth sections deal with the specific regions to which the first two pilot Regional Protection Programmes could apply; the last sections address how the pilot Regional Protection Programmes should be evaluated and sustainability assured and the steps to be taken next.

In order to ensure the coherence and effectiveness of Community assistance, the Commission may decide that non-ACP developing countries and regional integration bodies with ACP participation that promote regional cooperation and integration eligible for Community Assistance under Regulation (EC) No 1905/2006, Regulation (EC) No 1638/2006 of the European Parliament and of the Council of 24 October 2006 establishing a European Neighbourhood and Partnership instrument (14), the OCTs eligible for Community assistance under Decision 2001/822/EC, and the Community's outermost regions are eligible for funds referred to in Article 1(2)(a)(i) of the Internal Agreement, where the project or programme concerned is of a regional or cross-border nature and complies with Article 6 of Annex IV of the ACP-EC Partnership Agreement.

Article 174 (2) and (3) provides that ‘Community policy on the environment shall aim at a high level of protection taking into account the diversity of situations in the various regions of the Community,’ and that ‘in preparing its policy on the environment, the Community shall take account of . environmental conditions in the various regions of the Community . the economic and social development of the Community as a whole and the balanced development of its regions’.

Since the Convergence, Regional competitiveness and employment, and European territorial cooperation objectives cannot be sufficiently achieved by the Member States by reason of the extent of the disparities and the limit on the financial resources of the Member States and regions eligible under the Convergence objective and can therefore be better achieved at Community level through the multiannual guarantee of Community finance which allows cohesion policy to be concentrated on the Community's priorities, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

For the purpose of the analysis, this Communication defines border regions as regions at the NUTS II level [2] bordering (by land or sea) candidate countries currently negotiating accession which contain cross-border programmes under INTERREG III A in the period 2000-2006; this also includes regions enclosed by such regions (see map in Annex x).

(9) Whereas measures of Community interest undertaken at the initiative of the Commission have an important role to play in achieving the general objectives of Community structural action referred to in Article 1 of Regulation (EC) No 1260/1999; whereas, to that end, in view of the value it adds at Community level, it is important that the ERDF continue to promote cross-border, transnational and inter-regional cooperation, including in the regions located on the external frontiers of the Union within the meaning of the Treaty, the least-favoured islands and the outermost regions, in view of their special features and difficulties; whereas in the context of that cooperation, the harmonious, balanced and sustainable development of the whole of the Community territory, including in connection with spatial planning, adds value to action to promote economic and social cohesion; whereas the contribution of the ERDF to that development should be continued and increased; whereas moreover it is desirable to support the economic and social regeneration of cities and urban neighbourhoods in crisis with a view to promoting sustainable urban development;
