To allow those two Courts to exercise jurisdiction with respect to such defendants, the rules of Regulation (EU) No 1215/2012 should therefore, with regard to matters falling within the jurisdiction of, respectively, the Unified Patent Court and the Benelux Court of Justice, also apply to defendants domiciled in third States.

L’article 6, point 1, du règlement (CE) no 44/2001 du Conseil, du 22 décembre 2000, concernant la compétence judiciaire, la reconnaissance et l’exécution de décisions en matière civile et commerciale, doit être interprété en ce sens que la règle de concentration des compétences en cas de pluralité de défendeurs que cette disposition établit peut s’appliquer à l’égard d’une action visant à la condamnation à titre solidaire à des dommages et intérêts et, dans le cadre de celle-ci, à la production de renseignements, d’entreprises qui ont participé de façon différente, sur les plans géographique et temporel, à une infraction unique et continue à l’interdiction des ententes prévue par le droit de l’Union constatée par une décision de la Commission européenne, et cela même lorsque le demandeur s’est désisté de son action à l’égard du seul des codéfendeurs qui est domicilié dans l’État membre du siège de la juridiction saisie, à moins que ne soit établie l’existence d’une collusion entre le demandeur et ledit codéfendeur en vue de créer ou de maintenir, de manière artificielle, les conditions d’application de ladite disposition à la date de l’introduction de cette action.
