Maarten Verwey was formerly Deputy Director-General for the Directorate-General for Economic and Financial Affairs (ECIFN) before being appointed by President Juncker in July 2015 as Director-General of the Structural Reform Support Service, a service providing technical assistance for Member States to assist them in implementing growth-enhancing administrative and structural reforms.

Welcomes the adoption of the Strategy and the Action Plan on the reform of the judiciary 2013-2018, built around the key principles of independence, impartiality, competence, quality of the judiciary and freedom from political interference; urges the authorities to intensify this reform in line with the recommendations of the Venice Commission, especially with regard to the role of the parliament in judicial appointments and the independence of the prosecution, and with a view to the screening process of Chapter 23, which commenced on 25 September 2013; stresses the importance of strengthening the independence of High Judicial and State Prosecutorial Councils and reducing the backlog of cases, as a necessary condition for the successful sequencing of the entire reform process; calls on the authorities to provide all the necessary resources for the Judicial Academy, which should be instrumental in guaranteeing merit-based recruitments; emphasises the need for continuous training of judges and prosecutors to deal with complex financial cases and economic crimes; urges the authorities responsible to ensure a transparent and merit-based process of appointment of judges and prosecutors as well as a solid track-record of disciplinary proceedings against the judicial personnel; insists further on the need to ensure timely justice together with the unification of jurisprudence, the publication of, and easy access to, all judicial decisions immediately after adoption and the random allocation of cases in all courts; is concerned about the legal uncertainty arising from the number of judges carrying out their duties in acting capacity; reiterates the fact that a strong and independent judiciary is key to Serbia’s capacity to meet EU membership criteria;

Notes that Serbia is developing a new strategy for judicial reform, and supports the efforts being made to devise a new court system in order to improve the efficiency and independence of the whole judicial system; welcomes the government’s commitment to tackling shortcomings in the reform of the judiciary, particularly by ensuring that the legal framework leaves no room for undue political influence and addressing the issues of parliament’s power to appoint judges and prosecutors and the direct political participation of officials in the work of the High Judicial and State Prosecutorial Councils; underlines the importance of adopting clear and transparent evaluation criteria for appointed judges and prosecutors that will ensure their independence and professionalism; furthermore stresses the need to implement measures, in line with the recommendations of the Venice Commission, to address the growing backlog of cases; notes that the Justice Ministry still has responsibility for capital expenditure and that this could further limit the independence of the judiciary; calls on the government to focus on the quality of reform rather than its speed, using the available technical expertise from abroad; stresses also the need for initial and continued professional training of judges and prosecutors, following the extensive changes to the law;

Does the Commission consider that its reforms will have a genuinely positive impact on the citizens of Europe, and will it indicate what its current thinking is on the creation of new Commission responsibilities following enlargement? Will it support the appointment of individual Commissioners for issues relating to children, urban policy, the arts, sports, and social inclusion?

At the moment, therefore, while Parliament has still not taken a position on administrative reform – which we are observing with great attention and which we all hope will, this time, truly be a great success – I wish to say that it is appropriate at this stage to watch how the Commission is putting these good intentions, these projects to reform the appointments policy, into practice.
Mais pour l'instant, alors que le Parlement n'a pas encore adopté de position sur la réforme administrative - que nous suivons de très près et que nous souhaitons tous, au Parlement, voir se concrétiser une fois pour toutes -, je tiens à dire qu'il convient pour l'heure de voir si la Commission met en œuvre ces bonnes intentions, ces projets de réforme en matière de politique de nomination.

Therefore I believe – and this should include the strict current mandate for the Conference with regard to the revision of the institutions in accordance with the Treaty of Amsterdam – that we have to deal with the necessary and thorough reform of our Court of Justice and our Court of First Instance and the reform of the appointment of judges – in which the Parliament should have a significant involvement – as well as the reform of the distribution of competences between the Court of Justice and the Court of First Instance, so that citizens may have an accurate and clear idea of what this European justice, which is their direct form of justice, really is, and the reform, finally – and this is another chapter – of the actionability of the acts.
Aussi, - et je comprends même parfaitement le court mandat actuel pour la Conférence en ce qui concerne la révision des institutions à la suite du traité d’Amsterdam - je pense qu’il faut aborder la réforme nécessaire et profonde de notre Cour de justice et de notre Tribunal de première instance, la réforme de la nomination des juges - à laquelle le Parlement doit jouer un rôle important -, la réforme de la répartition des compétences entre la Cour de justice et de le Tribunal de première instance, de sorte que le citoyen puisse avoir une idée claire et précise de la justice européenne qui constitue sa justice directe, et enfin la réforme - et nous ouvrons là un nouveau chapitre - du caractère justiciable des actes.
