The European Commission is referring Poland to the Court of Justice of the EU for failing to ensure that the environmental impacts of exploratory mining drillings are properly assessed. Under Polish law, it is possible to drill down to depths of 5 000 metres without assessing the potential impact on the environment beforehand.
La Commission européenne assigne la Pologne devant la Cour de justice de l’Union européenne pour ne pas avoir veillé à assurer une évaluation correcte des incidences sur l’environnement de forages miniers exploratoires.Selon la loi polonaise, il est possible de forer jusqu’à des profondeurs atteignant 5 000 mètres sans procéder au préalable à l’évaluation des incidences potentielles sur l’environnement.

(3) Where the drilling of a well referred to in subsection (1) cannot be completed by reason of mechanical or other technical problems and if, within ninety days after the cessation of drilling operations with respect to that well, or such longer period as the Minister determines, the drilling of another well is commenced on any frontier lands that were subject to the exploration licence, the drilling of that other well shall, for the purposes of subsection (1), be deemed to have commenced prior to the expiration of the term of the exploration licence.
(3) En cas d’impossibilité de terminer le forage d’un puits en raison de difficultés mécaniques ou techniques et si, dans les quatre-vingt-dix jours qui suivent l’interruption — ou tel délai supérieur fixé par le ministre — , le forage d’un autre puits est entrepris sur les terres domaniales visées, celui-ci est réputé être un puits en cours de forage au moment de l’expiration du permis de prospection.

(2) Where the drilling of a well referred to in subsection (1) is suspended by reason of dangerous or extreme weather conditions or mechanical or other technical problems encountered in the drilling of the well, the drilling of that well shall, for the purposes of subsection (1), be deemed to be being pursued diligently during the period of suspension.

(2) The employer or employers shall keep a record of each meeting and drill referred to in subsection (1) in the building referred to in that subsection for a period of two years from the date of the meeting or the drill.
