28 (1) Where the Commission makes a decision to issue, amend or renew a licence, the Governor in Council may, within ninety days after the date of the decision, on petition in writing of any person received within forty-five days after that date or on the Governor in Council’s own motion, by order, set aside the decision or refer the decision back to the Commission for reconsideration and hearing of the matter by the Commission, if the Governor in Council is satisfied that the decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1).

Teleglobe has petitioned the Governor in Council to refer this decision back to the CRTC on three grounds: (a) the decision is not consistent with the new WTO agreement as it discriminates against one WTO member, the United States; (b) the decision does not respect the government's decision to establish a transition for the opening of the Canadian market, first for facilities-based competition on October 1, 1998, then to remove routing restrictions by December 31, 1999; and (c) the decision pre-empts a decision by the CRTC on a matter which it has out for consultation in Public Notice 97-34.
