IN-CONTEXT TRANSLATIONS

Thus, the Civil Service Tribunal disregarded, in the first place, the case-law according to which the statement of reasons for the decision rejecting a complaint is deemed to supplement the statement of reasons for the decision against which the complaint was directed (see, to that effect, Case T-562/93 Obst v Commission [1995] ECR-SC I-A-247 and II-737, paragraph 79, and Case T-71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I-A-339 and II-921, paragraph 79), in the second place, the principle of legality, according to which the reasons for a decision may be based only on factors which predate or are contemporaneous with it, and, in the third place, the purpose of the pre-litigation procedure consisting in giving the parties the possibility of finding an amicable solution to the dispute (Case T-86/98 Gouloussis v Commission [2000] ECR-SC I-A-5 and II-23, paragraph 61).

Where at least one of the authorities referred to in points (a) to (e) of the first sub-paragraph issues a negative reasoned opinion, the competent authority wishing to grant the authorisation shall within 30 days provide the authorities referred to in points (a) to (e) of the first sub-paragraph with a reasoned decision addressing the negative opinion.

Sixth and finally, the Civil Service Tribunal took note of the failure on the part of the Commission to produce the items of information requested by it by way of measures of organisation of procedure and, considering that the reasons put forward by the Commission to justify that failure were unconvincing, concluded that the decision of 19 June 2007 had to be annulled on the ground that there had been a breach of the obligation to state reasons (paragraphs 53 to 55 of the judgment under appeal).

Subsequently, after considering and allowing the first plea put forward by Mr Meierhofer, alleging breach of the obligation to state reasons (paragraphs 30 to 55 of the judgment under appeal, the Civil Service Tribunal annulled the decision of 19 June 2007 and ordered the Commission to pay the costs, while rejecting the other heads of claim on the ground that the Community judicature manifestly has no jurisdiction to issue directions to the Community institutions.

Information provided for under paragraph 1(a) and paragraph 2(a) shall include reasons or a brief summary of reasons for the decision concerned, except in the case of a jury decision or a decision where the reasons are confidential in which cases the reasons are not provided as a matter of national law.

For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).
