27 (1) A judge who has heard a case for which judgment is delivered pursuant to paragraph 26(1)(a) and who is absent from the delivery of judgment may sign a copy of the opinion with which the judge concurs or, where the judge has written an opinion, give the opinion to a judge present at the delivery of judgment, which concurrence or opinion shall be announced or read in open court and then left with the Registrar or reporter of the Court.
27 (1) Dans le cas de l’application de l’alinéa 26(1)a), le juge ayant instruit l’affaire mais absent lors du prononcé du jugement peut signer une copie de l’exposé des motifs auxquels il souscrit ou remettre à un juge qui sera présent à l’audience publique le texte de l’exposé de ses propres motifs. Communication est faite à l’audience de son accord ou de son exposé, l’un ou l’autre étant ensuite consigné par le registraire ou l’arrêtiste de la Cour.

I can understand the crimes against humanity and war crimes provision as applying, but to take the same words from those previous provisions and apply them to trafficking in persons, when you read the judgments that you addressed that said yes, we have extraterritorial jurisdiction, it was because of those very conventions and because they interacted with the judgment that, in my humble opinion, went a long way to guaranteeing its constitutionality.
Je comprends que les dispositions sur les crimes contre l'humanité et sur les crimes de guerre s'appliquent, mais à mon humble avis, le fait de reprendre les termes de ces dispositions pour la traite de personnes et de souligner que des jugements et des conventions indiquaient que la loi s'appliquait à l'étranger a été très utile pour garantir la constitutionnalité des jugements.

Welcomes the debate, resumed on the basis of the judgment of 13 September 2005 , on the powers of the European legislative authority in the area of criminal law; underscores the fact that, contrary to the approach championed by the Commission , it regards a case-by-case review of ongoing legislative proposals as necessary; remains of the opinion that the draft directive on the criminal law protection of the Community's financial interests should be based on Article 280 of the Treaty ; calls on the Council to abandon its rejectionist stance on strengthened protection for the Community's financial interests through criminal law measures and to move to the first-reading stage;
75. salue la reprise de la discussion engagée sur la base de l'arrêt de la Cour de justice du 13 septembre 2005 au sujet des compétences du législateur européen en matière de droit pénal; souligne que, contrairement à l'argumentation développée par la Commission , il estime nécessaire un contrôle au cas par cas des propositions législatives en cours; maintient sa position selon laquelle le projet de directive relative à la protection pénale des intérêts financiers de la Communauté doit se fonder sur l'article 280 du traité ; exhorte le Conseil à abandonner sa position de refus d'un renforcement de la protection des intérêts financiers de la Communauté par des mesures de droit pénal et à entamer la première lecture;
