(2) A series of legislative measures has been adopted at European level, opening up the rail freight and international rail passenger markets to competition and establishing, by way of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast), certain fundamental principles which include that railway undertakings shall be managed according to principles that apply to commercial companies, that entities responsible for the allocation of capacity and charging for rail infrastructure shall be separate from entities which operate rail services and that there shall be a separation of accounts, that any railway undertaking licensed in accordance with EU criteria should have access to railway infrastructure on fair, non-discriminatory terms, and that infrastructure managers may benefit from State financing.
(2) Une série de mesures législatives ont été adoptées au niveau européen, ouvrant à la concurrence le marché du fret ferroviaire ainsi que le marché des services internationaux de transport de voyageurs par chemin de fer et définissant certains principes fondamentaux dans la directive 2012/34/UE du Parlement européen et du Conseil, du 21 novembre 2012 établissant un espace ferroviaire unique européen (refonte). Ces principes comprennent notamment les éléments suivants: les entreprises ferroviaires doivent être gérées selon les principes applicables aux sociétés commerciales, les entités responsables de la répartition des capacités et de la tarification de l’infrastructure ferroviaire doivent être séparées des entités qui exploitent les services ferroviaires, il doit y avoir une séparation comptable, toute entreprise ferroviaire disposant d’une licence conforme aux critères UE devrait pouvoir accéder à l’infrastructure ferroviaire dans des conditions équitables et non discriminatoires, et les gestionnaires de l’infrastructure peuvent bénéficier d’un financement public.

4. Without prejudice to paragraph 3, Member States may exclude local and regional railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Article 8(3) and local railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Chapter IV. Member States shall notify the Commission of their intention to exclude such railway infrastructures.
4. Sans préjudice du paragraphe 3, les États membres peuvent exclure du champ d'application de l'article 8, paragraphe 3, les infrastructures ferroviaires locales et régionales qui ne revêtent pas une importance stratégique pour le fonctionnement du marché ferroviaire, et du champ d'application du chapitre IV les infrastructures ferroviaires locales qui ne revêtent pas une importance stratégique pour le fonctionnement du marché ferroviaire. Les États membres notifient à la Commission leur intention d'exclure ce type d'infrastructures ferroviaires.

La directive 91/440/CEE du Conseil du 29 juillet 1991 relative au développement de chemins de fer communautaires , la directive 95/18/CE du Conseil du 19 juin 1995 concernant les licences des entreprises ferroviaires et la directive 2001/14/CE du Parlement européen et du Conseil du 26 février 2001 concernant la répartition des capacités d'infrastructure ferroviaire et la tarification de l'infrastructure ferroviaire ont été modifiées de façon substantielle.

In order to avoid unnecessary financial and administrative burdens, it is necessary to clarify that railway undertakings having obtained a safety certificate in accordance with Directive 2001/14/EC of the European Parliament and of the Council of 26 February 2001 on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure and safety certification are not obliged to apply for a new safety certificate until 1st of January 2011.
Pour éviter des charges financières et administratives inutiles, il faut stipuler clairement que les entreprises ferroviaires qui ont obtenu un certificat de sécurité, conformément à la directive 2001/14/CE du Parlement européen et du Conseil du 26 février 2001 concernant la répartition des capacités et la tarification de l'infrastructure ferroviaire et la certification en matière de sécurité , ne sont pas obligées d'introduire une demande pour obtenir un nouveau certificat de sécurité avant le 1er janvier 2011.

The procedure established in order to coordinate the allocation of infrastructure capacity at an international level shall associate representatives of infrastructure managers for all railway infrastructures whose allocation decisions have an impact on more than one other infrastructure manager.
