TRADUCTIONS EN CONTEXTE

The Commission has decided to refer Portugal to the Court of Justice of the EU (the Court) for failing to comply with a previous judgement of the Court concerning EU rules on balancing the accounts of rail infrastructure managers. In Judgement C-557/10 of 25 October 2012, the Court ruled that Portugal was in breach of EU law (first railway package) for not adopting the national measures necessary to ensure that the accounts of the rail infrastructure manager are balanced.
La Commission a décidé de saisir la Cour de justice de l’UE (la Cour) d’un recours contre le Portugal pour non-respect d’un précédent arrêt de la Cour concernant les règles de l’UE visant à garantir l’équilibre des comptes des gestionnaires de l’infrastructure ferroviaire.Dans son arrêt du 25 octobre 2012 dans l'affaire C-557/10, la Cour a déclaré que le Portugal, en n’adoptant pas les mesures nationales nécessaires pour garantir que les comptes du gestionnaire de l’infrastructure sont en équilibre, a manqué aux obligations qui lui incombent en vertu du droit de l’UE (premier paquet ferroviaire).

(2) A series of legislative measures has been adopted at European level, opening up the rail freight and international rail passenger markets to competition and establishing, by way of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast), certain fundamental principles which include that railway undertakings shall be managed according to principles that apply to commercial companies, that entities responsible for the allocation of capacity and charging for rail infrastructure shall be separate from entities which operate rail services and that there shall be a separation of accounts, that any railway undertaking licensed in accordance with EU criteria should have access to railway infrastructure on fair, non-discriminatory terms, and that infrastructure managers may benefit from State financing.
(2) Une série de mesures législatives ont été adoptées au niveau européen, ouvrant à la concurrence le marché du fret ferroviaire ainsi que le marché des services internationaux de transport de voyageurs par chemin de fer et définissant certains principes fondamentaux dans la directive 2012/34/UE du Parlement européen et du Conseil, du 21 novembre 2012 établissant un espace ferroviaire unique européen (refonte). Ces principes comprennent notamment les éléments suivants: les entreprises ferroviaires doivent être gérées selon les principes applicables aux sociétés commerciales, les entités responsables de la répartition des capacités et de la tarification de l’infrastructure ferroviaire doivent être séparées des entités qui exploitent les services ferroviaires, il doit y avoir une séparation comptable, toute entreprise ferroviaire disposant d’une licence conforme aux critères UE devrait pouvoir accéder à l’infrastructure ferroviaire dans des conditions équitables et non discriminatoires, et les gestionnaires de l’infrastructure peuvent bénéficier d’un financement public.

Within two years after transposition of this Directive, Member States shall require infrastructure managers to participate and cooperate in a network to develop the Union rail infrastructure, in particular to ensure timely and efficient implementation of the trans-European transport network, including the core network corridors, rail freight corridors according to Regulation (EU) No 913/2010 and the European Rail Traffic Management System (ERTMS) deployment plan laid down in Decision 2012/88/EU, and the efficiency of regional cross-border cooperation within railway transport.

Les États membres exigent, dans un délai de deux ans après la transposition de la présente directive, que les gestionnaires de l'infrastructure participent et coopèrent à un réseau destiné à développer l'infrastructure ferroviaire de l'Union, notamment en vue d'assurer une mise en œuvre rapide et efficace du réseau transeuropéen de transport, notamment les corridors du réseau central, les corridors de fret ferroviaire en vertu du règlement (UE) n° 913/2010 et le plan de déploiement du système européen de gestion du trafic ferroviaire (ERTMS) fixé par la décision 2012/88/UE, ainsi que l'efficacité de la coopération régionale transfrontalière dans le transport ferroviaire.

Member States shall ensure that infrastructure managers participate and cooperate in a network to develop the Union rail infrastructure, in particular to ensure timely and efficient implementation of the trans-European transport network, including the core network corridors, rail freight corridors according to Regulation (EU) No 913/2010 and the European Rail Traffic Management System (ERTMS) deployment plan laid down in Decision 2012/88/EU.

Les États membres veillent à ce que les gestionnaires de l'infrastructure participent et coopèrent à un réseau destiné à développer l'infrastructure ferroviaire de l'Union, notamment en vue d'assurer une mise en œuvre rapide et efficace du réseau transeuropéen de transport, notamment les corridors du réseau central, les corridors de fret ferroviaire en vertu du règlement (UE) n° 913/201011 et le plan de déploiement du système européen de gestion du trafic ferroviaire (ERTMS) fixé par la décision 2012/88/UE.

The infringements raised with France and the United Kingdom concern the lack of independence of the rail infrastructure manager of the Channel Fixed Link and the insufficient implementation of provisions in the first railway package concerning rail access charging, the independent regulatory body and capacity allocation as regards the Channel Fixed Link.
Les procédures d'infraction lancées à l'encontre de la France et du Royaume-Uni portent sur le manque d'indépendance du gestionnaire de l'infrastructure ferroviaire de la liaison fixe transmanche et sur la mise en œuvre insuffisante des dispositions du premier paquet ferroviaire concernant la tarification de l’accès aux voies, l'autorité de régulation indépendante et la répartition des capacités pour ladite liaison.

Improved operations on international rail freight corridors will result from stronger cooperation between rail infrastructure managers on various operational issues, such as coordination of investments and works, capacity allocation and traffic management with due guarantee given to rail freight in terms of performance, reinforced cooperation with terminals, centralised publication of conditions for access and accrued powers for regulatory bodies to monitor non-discriminatory access.
L'exploitation des corridors internationaux de fret ferroviaire sera améliorée grâce à une coopération plus forte des gestionnaires d'infrastructure ferroviaire sur diverses questions opérationnelles, telles que la coordination des investissements et des travaux, l'attribution des capacités et la gestion du trafic. Des garanties seront également données au fret ferroviaire en matière de performances, de renforcement de la coopération avec les gestionnaires des terminaux, de centralisation de la publication des informations sur les conditions d'accès et d'accroissement des pouvoirs des organismes de contrôle sur la question des discriminations à l'accès.

This regulation will boost cross-border cooperation and coordination to give fresh impetus to the rail freight sector along major international rail corridors while taking full advantage of existing initiatives to modernise rail infrastructure under the TEN-T and cohesion policy and to deploy the European Rail Traffic Management System (ERTMS).
Ce règlement dynamisera la coopération et la coordination transnationales pour donner un nouvel élan au secteur du fret ferroviaire le long des principaux corridors ferroviaires internationaux. À cette fin seront dûment prises en compte les initiatives, d'une part, de modernisation de l'infrastructure déjà lancées dans le cadre du RTE-T et de la politique de cohésion et, d'autre part, de déploiement du système européen de gestion du trafic ferroviaire (ERTMS).

Rail freight in Europe will be given a boost thanks to new European Union rules designed to foster the development of a high-quality rail infrastructure management at international level.
