1. This Directive applies to any planned, existing or emergency exposure situation which involves a risk from exposure to ionising radiation which cannot be disregarded from a radiation protection point of view or with regard to the environment in view of long-term human health protection.

La présente directive s'applique à toute situation d'exposition planifiée, d'exposition existante ou d'exposition d'urgence comportant un risque résultant de l'exposition à des rayonnements ionisants qui ne peut être négligé du point de vue de la protection contre les rayonnements ou en ce qui concerne l'environnement, en vue d'une protection de la santé humaine à long terme.

2. For building materials which are identified by the Member State as being of concern from a radiation protection point of view, taking into account the indicative list of materials set out in Annex XIII with regard to their emitted gamma radiation, Member States shall ensure that, before such materials are placed on the market:

2. Without prejudice to the Directive 1999/2/EC, practices involving the activation of material resulting in an increase in activity in a consumer product, which at the time of placing on the market cannot be disregarded from a radiation protection point of view, shall be deemed not to be justified.

Sans préjudice des dispositions de la directive 1999/2/CE, les pratiques qui impliquent l'activation de matières entraînant une augmentation de l'activité dans un produit de consommation, qui, au moment de la mise sur le marché, ne peut pas être négligée du point de vue de la radioprotection, sont réputées non justifiées.

4. Member States shall prohibit practices involving the activation of materials used in toys and personal ornaments, resulting, at the time of the placing on the market of the products or of their manufacture, in an increase in activity, which cannot be disregarded from a radiation protection point of view, and shall prohibit the import or export of such products or materials.

La présente directive s’applique à toute situation d’exposition planifiée, d’exposition existante, d'exposition accidentelle ou d’exposition d’urgence comportant un risque résultant de l’exposition à des rayonnements ionisants en ce qui concerne la protection sanitaire des travailleurs, des personnes du public ou des patients et des autres personnes soumises à une exposition médicale, ou en ce qui concerne la protection de l’environnement.

The operational protection of members of the public in normal circumstances from practices subject to licensing shall include all arrangements and surveys for detecting and eliminating factors which, in the course of any operation involving exposure to ionising radiation, are liable to create a risk of exposure for members of the public which cannot be disregarded from the radiation protection point of view.
