Several CFSP decisions were taken by the Council concerning the Palestinian elections: the joint action of 19th April 1994 on support of the Middle East peace process [29], which announced the EU intention to give assistance and to observe the elections in the Occupied Territories; the Council Decision of 1st June 1995 [30], committing 10 million Ecus for this purpose, and the Council Decision of 25th September 1995, establishing a European Union Electoral Unit and defining the financial and administrative procedures for the observation of elections [31].

The purpose of this communication is therefore to assess the application of the Directive to the June 1999 elections, highlight the main problems that emerged, and publicise and encourage the good practices developed in certain Member States, with the aim of increasing participation by Union citizens in the political life of their Member State of residence.

26.1 (1) For the purposes of paragraph 40(2)(b) and the definition “principal residence” in section 54 of the amended Act, where a taxpayer owned, on December 31, 1971, a property that is a housing unit, a leasehold interest in a housing unit or a share of the capital stock of a cooperative housing corporation, if the housing unit was, or if the share was acquired for the sole purpose of acquiring the right to inhabit, a housing unit owned by the corporation that was ordinarily inhabited by the taxpayer, the taxpayer began at any time thereafter but before 1972 to use the property for the purpose of gaining or producing income therefrom, or for the purpose of gaining or producing income from a business, and the taxpayer elected in the taxpayer’s return of income for the 1974 or 1975 taxation year as if the taxpayer had begun to use the property for the purpose of gaining or producing income therefrom of for the purpose of gaining or producing income from a business on January 1, 1972, the taxpayer shall be deemed to have made an election under subsection 45(2) of the amended Act in the taxpayer’s return of income for the 1972 taxation year and to have so begun to use the property.

(2.3) For the purposes of this subsection and subsections (2.1) and (2.2), where an election under subsection (2.1) has been made by a corporation resident in Canada (in this subsection and in subsection (2.4) referred to as the “electing corporation”) in respect of an active business of a foreign affiliate of the electing corporation and the affiliate subsequently becomes a foreign affiliate of another corporation resident in Canada (in this subsection and in subsection (2.4) referred to as the “subsequent corporation”) that does not deal at arm’s length with the electing corporation, in computing the earnings of the affiliate from such business in respect of the subsequent corporation for any taxation year of the affiliate ending after the affiliate so became a foreign affiliate of the subsequent corporation, the subsequent corporation shall be deemed to have made an election under subsection (2.1) in respect of the business of the affiliate for the first such taxation year and for the purposes of paragraph (2.1)(d), the earnings of the affiliate for all of the preceding taxation years shall be deemed to have been adjusted in accordance with subsections (2.1) and (2.2) in the same manner as if the subsequent corporation had been the electing corporation.

(v.2) respecting the terms and conditions under which and the time and manner in which an election may be made in respect of a period of service specified in clause 6(1)(b)(iii)(M) or (N), the manner of determining in accordance with paragraph 7(1)(k) the amounts that are to be paid in respect of that election, the periods of service that may be counted for the purposes of that election, and the manner in which and extent to which section 8 and any regulations referred to in section 8 apply in respect of that election and to any contributor who makes that election and adapting any of those provisions for the purposes of that application;

32.3 (1) An employee may seek nomination as a candidate in an federal, provincial or territorial election before or during the election period only if the employee has requested and obtained permission from the Commission to do so (2) An employee may, before the election period, be a candidate in a federal, provincial or territorial election only if the employee has requested and obtained permission from the Commission to do so (3) An employee may, during the election period, be a candidate in a federal, provincial or territorial election only if the employee has requested and obtained a leave of absence without pay from the Commission (4) The Commission may grant permission for the purpose of subsection (1) or (2) only if it is satisfied that the employee's ability to perform his or her duties in a politically impartial manner will not be impaired or perceived to be impaired (5) The Commission may grant leave for the purpose of subsection (3) only if it is satisfied that being a candidate during the election period will not impair or be perceived as impairing the employee's ability to perform his or her duties in a politically impartial manner (6) In deciding whether seeking nomination as, or being, a candidate will impair or be perceived as impairing the employee's ability to perform his or her duties in a politically impartial manner, the Commission may take into consideration factors such as the nature of the election, the nature of the employee's duties and the level and visibility of the employee's position (7) The Commission may make permission under subsection (4) conditional on the employee taking a leave of absence without pay for the period or any part of the period in which he or she seeks nomination as a candidate, or for the period or any part of the period in which he or she is a candidate before the election period, as the case may be (8) An employee ceases to be an employee on the day he or she is declared elected in a federal, provincial or territo ...

For the purposes of this report, the Commission would draw particular attention to the rights taken from the Treaty establishing the European Community and grouped under Chapter V on citizens' rights: the right to vote and stand as a candidate at elections to the European Parliament (Article 39); the right to vote and stand as a candidate at municipal elections (Article 40); the right of access to documents (Article 42); the right to refer matters to the Ombudsman (Article 43); the right to petition the European Parliament (Article 44); freedom of movement and residence (Article 45); diplomatic and consular protection (Article 46).
